OWNER OCCUPANCY REQUIREMENTS
PART 1 - GENERAL
1.1 RELATED DOCUMENTS
A. All of the Contract Documents, including General Conditions, Supplemental Conditions,
and other Division 1 – General Requirements, apply to the work of this section.
B. This section contains general information that applies to all work performed under the
Contract and is inherently made a part of each specification section.
1.2 OWNER OCCUPANCY REQUIREMENTS
A. Maintain Owner Occupancy: Maintain the Owner's occupancy at the Station Avenue
Elementary School throughout Phase 1 of the Contract.
1. Perform work of the Contract with the least disturbance to the Owner's normal
operations.
2. Do not interfere with the Owner's normal school operations.
3. Perform work of the Contract without damage to or loss of the Owner's property.
4. Avoid creating any nuisance.
5. Minimize disturbance to building occupants.
B. Schedules and Work Plans: Before beginning work which could disrupt or inconvenience
the Owner or building occupants, submit detailed and accurate schedules and work plans
and obtain the Owner's and Architect's written approval before proceeding with work.
Coordinate Contract operations with the Owner to avoid conflicts. In all cases of conflict,
the Owner's operations and business shall have priority.
C. Revised Work Plan: Notify the Owner's Representative before the end of each week
about intended work locations for the upcoming week if there are any unexpected and
unavoidable deviations from the approved Work Plan. Obtain approval from the Owner
prior to implementing the revised Work Plan.
D. Special Scheduling: At no additional cost to the Owner and at no change in Contract
Amount, perform all activities which may produce objectionable conditions only when the
building is not occupied. Ensure that the objectionable condition is dissipated or resolved
prior to the Owner's next scheduled occupancy or business period.
E. Advance Notice and Permission Required: Provide at least 5 days written notice to the
Owner and obtain the Owner's written approval before entry into any Owner occupied
space.
F. Hours of Work: The contract work shall be performed as “first shift” (7AM to 3PM) with
prior approval work may happen on “second shift” (3PM to 11PM) as to minimize the
disruptive effects of a construction contract on the owner’s operations.
1. Deliveries may not disrupt campus arrivals or departures, no deliveries will be
allowed during the following periods without prior approval during school days

b. 1:45 to 3:30 PM
2. All deliveries are to access the site from Station Avenue – Station Avenue cannot be
blocked by any vehicle at anytime – careful coordination of delivery and site
acceptance of deliveries is required.
3. The 2020-2021 & 2021-2022 Academic Schedules are attached as appendix –
holidays and breaks may be treated as first shift time periods.
G. Premium Time and Overtime: The Owner and Owner’s Representative may restrict the
Contractor's entrance into and work in Owner occupied areas to times other than the
Owner's normal hours of occupancy and operation. Include all costs for "premium time"
and overtime" related to work in Owner occupied areas in the base Contract Amount.
H. Owner's Overtime: If the Owner is required to provide its personnel to operate or secure
the facilities to support the Contractor's work at times when the Owner's personnel are
not normally present, the Contractor shall bear all costs related to the Owner's additional
personnel costs and shall reimburse the Owner in full.
I. Work Limits: Restrict Contract related materials, debris, equipment, personnel, temporary
facilities, and operations to within "work limits" indicated or approved by the Owner and
Owner’s Representative. The "work limits" approved by the Owner and Owner’s
Representative define the demarcation between Contractor operations and Owner
operations. The "work limits" do not change the requirements of the Contract which may
include work outside the "work limits".
1.3 ADDITIONAL OWNER OCCUPANCY REQUIREMENTS
A. Egress: Do not obstruct any existing egress including egress access or egress
discharge, except where temporary alternative egress has been first established and
approved by authorities having jurisdiction.
B. Fire Protection Systems: The existing buidling does not have a fire supression system.
C. "Hot" Work: Take every possible precaution to prevent fire. Strictly comply with the
Owner's fire and safety procedures and regulations including permit requirements.
1. "Hot Work" means welding, torching, soldering, brazing, any other work which
requires an open flame or hot tool, and any other work which could cause fire.
2. Provide effective and operational fire extinguishers within reach of all "hot" work
operations.
3. Provide "fire watches" as required by authorities having jurisdiction.
D. Utilities. Services. and Interruptions: Do not interrupt any services, utilities, or facilities
serving Owner occupied areas. Protect and maintain all utilities and services serving
Owner occupied building including, without limitation, heat, power, water, fire protection,
fire alarms, security, technology, public address, intercom, telephone, and CCTV.
E. Interruptions: Where service interruption is unavoidable, provide at least five days
advance request to the Owner and obtain the Owner's written permission. In the request,
provide information on the intended date and times of service interruption. Provide
information on date and time when service will be restored. Provide information on
temporary services to be provided.

F. Scheduling and Costs: Schedule all utility and service interruptions during weekends,
holidays, nights, or at other periods non-use as approved by the Owner. Include all costs
for "premium time" and "overtime" related to utility and service interruptions in the Base
Contract Amount.
G. Public Utilities: Give all notices and obtain all permits required by law. Prior to any
temporary or permanent disconnection or interruption of utilities, services, or facilities,
notify the utility company and obtain written approval from the utility company and
authorities having jurisdiction.
H. Owner's Private Utilities: Perform all work, including service extensions, tests, and
approvals related to the Owner's private utilities and services only under the direct
observation of the Owner's Representative. Prior to working on any utility system, notify
the Owner's Representative.
I. Contract Document Limitations: Utilities and services are shown at approximate locations
and these locations may not be accurate. All utilities and services are not shown on the
Contract Documents. Determine exact utility and service locations in the field before
beginning work near utilities.
J. Uncharted Utilities and Inaccurately Indicated Utilities: If uncharted utilities or inaccurately
located utilities are discovered, protect and maintain such utilities, and notify the utility
owner, project Owner, and Architect immediately. If utilities are inadvertently damaged,
take reasonable action to minimize the damage and restore the system to original
condition and operation. Provide temporary utilities to maintain occupancy and
continuous support of areas served by the utilities.
K. Coordination Required: Fully and completely coordinate all construction operations,
installation of equipment, utilities, services, and other work to avoid all interference with
existing utilities not indicated to be removed. Provide proper disposition, in a manner
acceptable to Owner and Architect, of all existing utilities and services that in any way
interfere with the work, whether or not they are indicated in the Contract Documents.
L. Contact "Dig Safe": Comply with Massachusetts General Laws, Chapter 82, Section 40
and all applicable codes, rules, regulations. Do not begin any excavation without
complying with the law. Ensure that all utilities have been located and marked prior to
beginning any excavation work.
M. Contractor's Responsibility: Be responsible for all damage and injury resulting from work
on or near utilities and services, and all costs to restore and repair utilities, and all costs
for temporary replacement utilities.
N. Abandoned Utilities: If not otherwise indicated, remove abandoned utilities in their
entirety, except earth buried and concrete encased utilities may be abandoned in place.
For all utilities abandoned in place, cut, cap, and make the utilities safe.
O. Work Within Owner Occupied Areas: In general, isolate Owner areas from Contractor
areas as shown on the contract documents and as specified. When work within Owner
occupied areas is unavoidable and permitted by the Owner, comply with the following
requirements:
P. Preliminary Inspection and Record: Prior to beginning any work in any Owner occupied
area, representatives of both the Contractor and the Owner shall jointly inspect areas in
which work is to be performed to determine and record the existing cleanliness and
existing deterioration and damage, if any.

Q. Final Inspection: Prior to completion of the Contract operations in each specific Owner
occupied area and as a prerequisite to payment for the work, representatives of both the
Contractor and the Owner shall jointly inspect areas in which work was performed to
determine and record in writing the level of cleanliness and deterioration and damage, if
any.
R. Correction by the Contractor: At no additional cost to the Owner, the Contractor shall
immediately correct all deficiencies, including damage to the building, damage to
furnishings, damage to equipment, and all other damage caused by the Contract
operations discovered during the Final Inspection. For items that cannot be restored to
their original condition, a reasonable and fair amount shall be deducted from the Contract
Amount to pay for replacement.
S. Daily Cleaning: Thoroughly clean-up and remove all dirt, dust, and debris resulting from
Contract operations at the end of each Contract work period and before the Owner's next
normal business period.
T. Final Cleaning: Prior to completion of the Contract operations in each specific Owner
occupied area and as a prerequisite to payment for the work, remove all spots, stains,
dust, and dirt resulting from Contract operations from all surfaces including furnishings
and equipment.
U. Protection: Provide effective temporary protection to protect the property of the Owner
and occupants near areas of Contract operations within Owner occupied areas. Without
limitation, protect finishes, equipment, furnishings, and personal property. Protect to
maintain original, pre-Contract conditions.
V. Security: Cooperate with the Owner and follow the Owner's security procedures and
directions. Control and restrict access to Owner occupied areas. Restrict access to areas
of Contract operations to control injury to Owner's personnel and building occupants.
W. Fibrous Materials and Fibers: Do not expose any fibers or fibrous material in any Owner
occupied area at any time. Control, cover, and conceal all fibrous materials to prevent
fibers from being released into the Owner occupied area.
X. Telephones: Do not use the Owner's telephones or other communications systems or
equipment.
Y. Noise and Exhaust Fumes from Vehicles. Engines, Machines. and Equipment: Do not
operate any vehicle, machinery, equipment, or engine less than 50 feet from the nearest
Owner occupied area, except where specific prior written permission has been obtained
from the Owner.
Z. To the greatest extent possible, position vehicles, machines, equipment, and engines so
the engine exhaust is directed away from Owner occupied areas. Provide tightly sealed
carbon-activated filters over exterior openings and/or louvers where fresh air is drawn
into the building within 50 feet of any combustion engine construction device.
AA. Noise Ordinances – see Chapter 104 of the By-Law for the Town of Yarmouth.
a. No excessive noise shall be permitted between the hours of 11 PM and 7 AM.
