The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners’ packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. Submitting an Application: 1 original application with original signatures (double sided). A detailed project narrative to include sufficient information to enable the Commission to determine whether the proposed work will alter an area subject to protection (in hardcopy form). BVW delineation sheet(s), coastal bank calculation and other relevant material (in hardcopy form). 1 hardcopy of a Yarmouth Assessor’s locator map highlighting parcel(s) where work is proposed, including map and parcel numbers. Assessor’s maps can be found at www.yarmouth.ma.us/70/Assessor If the applicant is not the property owner, please submit a signed Site Access Authorization Form; AND The owner must be sent a copy of the application via Certified Mail on the same day it is filed with this office. Please submit a copy of the Certified Mail receipt with application. 1 original and 7 photocopies of the plan/sketch, folded separately, right side out with title visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed and existing conditions, native species, size and spacing. A pdf copy of the application, supporting information and plan/sketch emailed to kgrant@yarmouth.ma.us. Please put the property’s street address in the pdf file name. Local filing fee – separate check payable to “Town of Yarmouth”. Legal ad fee – separate check payable to “Town of Yarmouth”. Project Description (cont.) b. Identify provisions of the Wetlands Protection Act or regulations which may exempt the applicant from having to file a Notice of Intent for all or part of the described work (use additional paper, if necessary). The proposed project is only within LSCSF FEMA zone AE, which currently has no performance standards under the WPA. This site is over 500-feet inland from the nearest VE Floodzone, therefore impacts from wave action during storm events is not likely. Although the proposed work will increase impervious area on the Site, various stormwater features will be installed to control stormwater. Therfore, no adverse impacts to LSCSF are anticipated as a result of this project. 3. a. If this application is a Request for Determination of Scope of Alternatives for work in the Riverfront Area, indicate the one classification below that best describes the project. Request for Determination of Applicability 10 Moss Road West Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project at 10 Moss Road, in West Yarmouth (the Site) consists of the permitting of an inground pool and associated patio and fencing, along with various sheds, paver stone patio with path and fire pit, and stormwater features (the Project). This application is being submitted in accordance with the Massachusetts Wetlands Protection Act (WPA) and the Town of Yarmouth Wetlands Protection Bylaw (the Yarmouth Bylaw). 2.0 SITE DESCRIPTION The property located at 10 Moss Road in West Yarmouth, is bordered by private residences and undeveloped forest areas. The lot is currently developed with a single-family dwelling. The wetland resource areas and areas of conservation jurisdiction on or adjacent to the Site, that are protected under the Wetlands Protection Act and the Town of Yarmouth Wetland Protection Bylaw include Land Subject to Coastal Storm Flowage, Zone AE, elevation 11. A wetland delineation conducted by BSC Group revealed no other jurisdictional resource areas on or within 100-feet of the property. NHESP Priority Habitat (NHESP PH) located to the north, northwest, and south of the property are divided from the Site by at least a paved roadway or an additional parcel and all proposed work is located over 100-feet away from the closest NHESP PH. 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Proposed Inground Pool/Patio/Sheds: The proposed project at the site consists of a proposed 14’ x 28’ inground pool, surrounded by a concrete patio. A paved patio with firepit and stone walkway are proposed adjacent to the pool and patio. These features will be enclosed by a pool fence. A 500-gallon H-20 drywell with a 4’ stone apron surrounding for the purpose of pool drawdown will be installed to the north of the proposed pool. Drywells to control stormwater run- off are also proposed on the Site. A row of evergreen trees to act as a privacy screen for the pool area are proposed beyond the southern edge of the pool fence. In addition, three sheds in various locations around the site are also proposed. As there are currently no performance standards for proposed work within LSCSF FEMA floodzone AE, no adverse impacts to this resource areas are anticipated as a result of this work. Clearing will be limited to only the area needed to construct the aforementioned features and disturbance of soils on Site will be stabilized with grass seed and any other measures necessary immediately following work activities. 4.0 MITIGATION All construction materials will be staged in developed areas. All debris from the Site will be contained in roll-off container stored in upland areas and will be removed from the Site in a timely manner. Any areas where soils are disturbed during construction will be seeded with grass seed and stabilized immediately following work.
