Mr. Poyant,
Independent Environmental Consultants, Inc. represents the current property owner, Jeffrey Gabriels, of
18 Roads End, Yarmouth, MA.
1. The applicant has filed a Notice of Intent application (2021) for an existing timber wall located
upgradient of Long Pond in Yarmouth. The previous property owner, Walter Taylor, a family member,
had the timber wall constructed in 1979.
2. Mr. Gabriels is seeking an Order of Conditions (2021) for the existing timber wall that was
constructed in 1979 without an Order of Conditions.
3. The existing timber wall was constructed in 1979 upgradient of Long Pond, an upgradient of a wide
sandy beach located at the shoreline of Long Pond. The timber wall was constructed within the 100’
buffer zone of Long Pond. The construction of the timber wall did not alter any regulated wetland
resource areas in 1979. The applicant is seeking an Order of Conditions for the existing timber wall,
which is located within the 50’ buffer zone and the 100’ buffer zone of the edge of wetlands of Long
Pond. The existing timber wall was constructed within an existing upland area of land (non-wetland
area) in 1979. The construction of the timber wall is located within the 100’ buffer zone (upland area) of
Long Pond. No bordering vegetated wetlands were altered for the construction of the timber wall. 0 sq.
ft. of wetland resource areas were altered for the construction of this timber wall, which was
constructed in 1979. All timber wall construction occurred within the 100’ buffer zone area.
4. The applicant is requesting an Order of Conditions (2021) for the past construction of this timber wall
(1979) located within the 100’ buffer zone of Long Pond in Yarmouth, MA.
