January 21, 2021 The Building Department has been in contact with you in a letter dated October 7, 2020 about an accessory apartment created without the required relief from the Zoning Board of Appeals. To date there has been no application submitted for relief. This is a violation of section 407.2 of the Town of Yarmouth Zoning Bylaws; 407.2 Standards and Requirements. "The Board of Appeals may authorize accessory apartments only by special permit" Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed. 101.3 Penalties. Any person violating any of the provisions of this bylaw shall be fined not more than three hundred dollars (5300.00).for each offense. Each day that such violation continues shall constitute a separate offense. You are hereby ordered to abate and or correct said violations immediately, or seek relief from the Zoning Board of Appeals as allowed by MGL Ch 40a §7 & §15. The 30 day appeal period allowed under MGL Ch 40A §15 has lapsed. Accordingly, the zoning violation may not be contested and your compliance is required. Failure to do so may result in criminal/civil complaints being filed against you. You are required to respond to this letter within 7 days of receiving this letter. It has come to the attention of the building department that there is an accessory apartment at this property without the required relief from the zoning board of appeals.
