The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners' packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. The 18,582 square foot property is currently improved with a two bedroom single family dwelling. The site is bordered on the North by a Bordering Vegetative Wetland (BVW) and the site is within FEMA flood zone AE (El 11) and AE (El 12). These resource areas and their associated buffers are plotted on the enclosed Site Plan by Down Cape Engineering Inc. The existing dwelling, and its septic system, will be removed from the site and the new dwelling and Title 5 septic system will be constructed to meet all relevant flood zone and building code requirements. This will include flood vents in the non -habitable crawlspace below the first floor. 1,950 square feet of mitigation plantings are proposed consisting of a mix of native shrub species. A work limit line of staked silt fence backed by coir logs is proposed along the existing lawn area at the North of the site. This work limit line shall remain in place for the duration of the proposed work and until lawn areas and plantings have been stabilized. Exposed soils will be loamed and seeded within 30 days of completion of the work and final grading work as weather permits. No work will take place within Priority/Estimated Habitat of endangered species. Land Subject to Coastal Storm Flowage The site is affected by 100-year flood elevations AE (el 11) and AE (el 12). The proposed dwelling and deck will conform to floodzone and bung code standards. Minimal re -grading is proposed, largely limited to what is required for the new septic system, so construction and grading activities will have no effect on the 100-year flood elevation. Approximately 300 cubic yards of fill will be required. Bordering Vegetated Wetland (310 CMR 10.55) The Bordering Vegetated Wetland was flagged by Goddard Consulting LLC and located by Down Cape Engineering inc. A new 2-bedroom Title 5 septic system is proposed and will be located approximately 80' to the BVW at its closest point. There will be no increase in the number of bedrooms over what currently exists. The existing structure is 19.7' from the BVW at it's closest point. The proposed deck will be 21.4' from the BVW at it's closest point. Removal of existing yard waste and debris within the resource area and it's buffer is proposed. No adverse effects from the work are expected, as the work limit line shall remain staked in place until all work is complete and the site is stabilized. The BVW will continue to act fully in its capacity to provide habitat and food sources for wildlife. Compliance with the MA Wetlands Protection Act and Yarmouth Bylaw Chapter 143 Regulations: The proposed construction activities will not have a deleterious effect upon any wetland values as listed in the Bylaw. The proposed dwelling will be further away from the resource areas than the existing dwelling. The silt fence will contain all construction activities. The area where the work will take place has a very gentle slope; no erosion is expected. Roof drainage will be mitigated utilizing downspouts to drywells or drip lines to stone trenches. All machinery will access the areas of proposed construction through the existing driveway. A silt fence will be installed downgradient of any proposed work. Alternatives Analysis The alternative would be to do nothing, which is unacceptable to the potential owners. A 100 year event could cause significant damage to the dwelling due to its current elevation in relation to the flood elevation. The dwelling is older and would require significant repairs which would not be possible due to the non- conforming nature of the dwelling in respect to the FEMA flood design requirements. The proposed dwelling and septic have been located such that they are as far from the resource areas as is feasible with this site given septic and zoning setback requirements. Mitigation Waivers from the 35' buffer and 50' structure conservation setbacks are requested. Hardscape square footages within the 0-35 buffer are being reduced, and within the 35-50' buffer hardscape is also being reduced from existing conditions. Significant mitigation is proposed at greater than a 1:1 ratio to offset the increase in hardscape on the site, within the 50-100' buffer.
