Hi Andrew and Kelly, I'm responding to Andrew's comments issued in conjunction with our DEP file number for the Notice of Intent at 1167 Great Island Road: Yes - there is perennial stream noted on GIS within 200 feet of our parcel. During the course of the ANRAD (SE 083-2255) process at this property we determined that this perennial stream is a tidal creek within the salt marsh that does not fit the criteria of being a "River". The issue was discussed at length with the Yarmouth Conservation Commission during the public hearing for the ANRAD including the following points: 1) DEP Wetland maps classify the salt marsh as tidal flats and salt marsh. 2) The DEP Mouth of Coastal River Wetland Maps do not identify the tidal creek as having a coastal river mouth. 3) Field observations confirm this is an isolated salt marsh with no streams flowing into it from any adjacent upland wetlands. The tidal creek is considered part of the salt marsh if it substantially drains at mean low water (which it does) and if it is within or substantially surrounded by salt marsh vegetation (which this is).
