A shellfish survey is required but please note that the Commission is revising the regulations with regard to shellfish
surveys and will accept applications using this method:
A shellfish survey conducted by a qualified marine or shellfish biologist or other acceptable environmental
professional to be approved by the Shellfish Constable including written results, plan and
methodology. Survey plots shall be three (3) feet by three (3) feet in area, spaced every 20 feet from the mean
high water line, 10 feet off each side of the dock and float.

Hi Kelly and Karl,
I hope all is well with you both and you are having some holiday absenteeism (aka vacation). In the event that
you might be around, I’ve a question for you on behalf of my client Frank Lloyd, applicant.
I’m preparing a plan to accompany a NOI for a reconstruction of the pier ramp and float at 222 Pleasant
Street. No changes except the piling count will go down because we can increase the span between pile
bents, 10 ft. going to 12 ft.

The existing facility existed for decades, received a 91 license in 1991 and is weathered and damaged, basically
needs replacement.
We had shellfish surveys in the general area in recent years and not much was revealed, perhaps due to the
swift current.
I have a cost estimate for a shellfish survey of $1,700 for 222 Pleasant Street and the question comes to me to
check back with you:
The Yarmouth regulation relating to docks and shellfish surveys follows:
(k) A shellfish survey conducted by a qualified marine or shellfish biologist or other acceptable
environmental professional to be approved by the Shellfish Constable including written results, plan and
methodology. A minimum of three (3) transects spaced every eight (8) feet shall be performed from mean
high water to a minimum of thirty (30) feet beyond the structure and shall extend a minimum of twenty (20)
feet widest portion of the structure. Each sample shall be a four (4) feet by four (4) feet square spaced every
ten (10) feet.
For perspective relating to the question, page 19 of the regs. has item 11 below. Item 11 appears to
indicate that flexibility in the regulations is available for expansions to existing piers. The 222 Pleasant
Street pier is not being expanded.
(11) Where there is an expansion of an existing dock, the Commission may require compliance with all or
part of these regulations. Again, no expansion.
The question: Is a shellfish survey for a reconstruction project like this mandatory ?
