I had the same thought about the RDA. We should be able to issue it based on the type of determination being sought.
I do anticipate issues with the COC now that is appears there was encroachment on to town property with fill and
clearing. I will be speaking with the chairman tomorrow and will let you know if I have any other feedback before the
meeting.

I spoke with Kieran about your question regarding the property lines for 97 Pheasant Cove Circle. Kieran told me he
would look into it before the hearing, but he believes the property lines shown on our plan are correct. I will get back to
you about this and/or have the answer prior to the hearing.
I spoke with Matt Creighton who did the delineation for 97 Pheasant. He said when he did the delineation, he based the
wetland line on the vegetation bc he did not know the lawn had been illegally created. Matt said maintained lawn is not
considered a wetland under the WPA (provided the maintained lawn was established prior to the Act). So now we know
the lawn in that area was illegally created and the Wetland Flag line shown on the plan is not accurate.
However, in the RDA we are not requesting to confirm the wetland boundary line. We are requesting approval of the
project; which is simply to install two new landings, modify two existing landings, and adding the shed. The top of the
coastal bank is the nearest resource area and is correctly shown on the plan. Also as shown in the photos with the

RCOC’s the cleared area has now been planted with native species. Can we proceed with the RDA as is or do you need a
revised plan with revised wetland delineation?

I would like more information on how the wetland delineation was done for this site. The disturbed area that was
replanted has been excluded from the wetland delineation but the visual characteristics, topography and abutting
wetlands indicate the wetland continues through this area.
Please provide further details or revisit the delineation to confirm conditions.
