Administrative Checklist
Request for Determination of Applicability
General Information:
All filings must be made on Town of Yarmouth forms found at www.yarmouth.ma.us/325/Conservation. The
filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new
information may be accepted into the Commissioners’ packets within the week before a meeting.
Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be
advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you
need assistance.
Submitting an Application:
1 original application with original signatures (double sided).
A detailed project narrative to include sufficient information to enable the Commission to determine whether
the proposed work will alter an area subject to protection (in hardcopy form).
BVW delineation sheet(s), coastal bank calculation and other relevant material (in hardcopy form).
1 hardcopy of a Yarmouth Assessor’s locator map highlighting parcel(s) where work is proposed, including
map and parcel numbers. Assessor’s maps can be found at www.yarmouth.ma.us/70/Assessor
1 original and 7 photocopies of the plan/sketch, folded separately, right side out with title visible. All plans
shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed
and existing conditions, native species, size and spacing.
A pdf copy of the application, supporting information and plan/sketch emailed to kgrant@yarmouth.ma.us.
Please put the property’s street address in the pdf file name.

sent to DEP.
Submit a copy of any Certified Mail receipts (PS Form 3800) for others, such as Massachusetts Natural
Heritage and Endangered Species Program, Massachusetts Division of Marine Fisheries, etc.
Alternatively, you may visit their websites for electronic filing information. If filed electronically, please copy

Dear Ms. Grant and Chairman Hoopes,
On behalf of the applicants, Margy and Curran Simpson, Marsh Matters Environmental (MME) submits the
enclosed Request for Determination of Applicability (RDA)(WPA Form 1), project site plan, architectural
drawings, existing conditions photos, and other required supporting documentation seeking written
authorization (a Determination of Applicability) to replace decks and construct additions to a single-family
residence at 30 Moss Road in West Yarmouth (the Site). MME submits this RDA pursuant to the
Massachusetts Wetlands Protection Act (M.G.L. Ch. 131, § 40), the Town of Yarmouth Wetland Bylaw (local
bylaw)(Chapter 143) and its regulations (§1.00-4.00), the implementing state regulations (310 CMR 10.00),
and local application submission guidelines. Please accept this application cover letter as the required
narrative describing existing conditions, providing proposed project details, and explaining regulatory
compliance.
Existing Conditions
The property is a 0.41-acre parcel in a residential neighborhood of Yarmouth located just east of Lewis Bay
and north of Seagull Beach (see site locus figures in Attachment 1). According to the FEMA Flood Insurance
Rate Map for this area, all of the properties on Moss Road are located within the coastal floodzone (Zone
AE – Elevation 11) (Figure 3) and, therefore, the property is within Land Subject to Coastal Storm Flowage
(LSCSF) (310 CMR 10.04). The regulations define this wetland resource area as “land subject to any
inundation caused by coastal storms up to an including that caused by the one-hundred-year storm, surge
of record or storm of record, whichever is greater.” There are no other wetland resource areas, or wetland
resource area buffer zones, extending to the project areas. The vegetated resource areas nearest the Site
are a wetland located to the north on the opposite side of Radio Lane and a coastal marsh located behind
the coastal dune abutting Seagull Beach to the south (see Figure 2A).
Proposed Project and Regulatory Compliance
As the project plans illustrate, the proposal will replace an existing ground-level deck at the rear of the
house, remove a deck and construct an addition to the west side of the house, and replace a deck and
construct a bump-out addition at the front of the house. Adjustments to the property’s land topography
will not be necessary. Areas within the project footprints, that are not already structure, consists of only
existing lawn and planting bed. The building contractor may need to remove, or prune back significantly,
the two cedar trees nearest the addition footprint on the west side of the house in order for there to be
sufficient room to dig the new foundation and construct the one-story addition. Disturbance of any
additional naturally occurring, native vegetation will not be necessary in order to construct the project.

There are no project performance standards for LSCSF in 310 CMR 10.00. Regulation 2.10 of the
implementing regulations of the local bylaw defines Land Subject to Flooding or Inundation by Coastal
Flowage to be “areas that extend up-gradient or landward from the ocean and the ocean’s estuaries to a
point where the maximum lateral extent of floodwater will theoretically terminate based upon the 100-year
frequency storm. Said boundary shall be the relevant 100-year storm elevation referenced within the latest
available Flood Insurance Rate Maps provided by (FEMA).” As stated at Regulation 2.10, projects that occur
within LSCSF are likely to have adverse impacts on flood control, storm damage prevention, prevention of
pollution, public water supply, land containing shellfish, wildlife, wildlife habitat, protection of groundwater
supply and quality, and protection of fisheries. MME believes that the proposed project meets all of the
LSCSF performance standards described at 2.10(3)(a, b, and c) and, therefore, the projects supports the
protected interests.
As this permit application is a Request for Determination of Applicability, MME understands that the
Yarmouth Conservation Department filing instructions do not require property abutter notification of the
project and the February 3 public hearing date. MME has enclosed a check in the amount of $75.00 to
cover the application filing fee and $10.00 to cover the legal advertisement cost. MME will provide a digital
copy of this application package to your office and to MassDEP as required. Please do not hesitate to
