The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners' packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. N Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstandinglexpired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. Abutters list must be certified by the Town Assessor's office. The / Assessor's office requires 7 days advance notice. A pdf copy of signed application, supporting information, and plan emailed to kgrant(cDyarmouth.ma.us. Please list project property's street address in the pdf file name. /Submit Certified Mail Receipts (PS Form 3800) for all abutters. The property in improved with an existing 3-bedroom single family dwelling and is surrounded by residential dwellings. The site is located within floodzone X (area of minimal flood hazard) with an isolated vegetated wetland located on the east side of the property. The Isolated Vegetated Wetland was flagged by Brad Hall of BLH Environmental Consulting and located by Down Cape Engineering. The vegetation sheet is enclosed as part of the filing. All construction associated with the new pool and septic will take place greater than 35' from the Isolated Vegetated Wetland. The IVW will continue to act fully in its capacity to provide habitat and food sources for wildlife. The new septic system will be relocated from the rear of the property to the side which will provide a greater buffer between it and the IVW. The resource areas and its associated buffers are plotted on the enclosed Site Plan by Down Cape Engineering. A Work limit line of staked silt fence backed by coir logs is proposed downgradient of the proposed work. All work limit lines shall remain in place until all construction is completed and areas are planted and stable. Preconstruction activities will include the installation of erosion control fences as shown on the site plans. Any staging areas will be located outside the 100' buffer to the IVW. Exposed soils will be loamed and seeded within 30 days of completion of the work and final grading work as weather permits. No work will take place within Priority/Estimated Habitat of endangered species. Compliance with the MA Wetlands Protection Act and Yarmouth Bylaw Chapter 143 Regulations: The current septic system was designed based on 3 bedrooms; there will be no increase in flow. When the septic system was installed back in 2008 the IVW was determined not regulatable by the Conservation Agent. Based on the most recent survey, the area of the IVW was measured to be 3,275 s.f. which is just over the 3,000 s.f. requirement for a regulatable wetland under the local bylaw. The proposed leaching field will be moved to 61.2' off the IVW. Currently it is only 32.8' away. A 5' separation between the bottom of the system and seasonal high groundwater will remain. A filing with the Board of Health for variances is expected. The proposed pool and patio will be located within existing lawn and landscaped areas. The closest point of the proposed patio to the IVW is 35.9'. The existing shed will be relocated further away from the IVW than where it currently exists. The proposed construction activities will not have a deleterious effect upon any wetland values as listed in the Bylaw. A work limit line is proposed downgradient of all proposed construction. No adverse impacts are expected to the Isolated Vegetated Wetland. A mitigation area of 1,564 s.f. is proposed to help offset the increase in hardscape of 1,543 s.f. within the 100' buffer to the IVW. This mitigation area includes existing lawn areas, garden areas, and areas filled with compost and landscape debris that were present when the current owners purchased the property in 2021. -1- Construction Protocol All machinery will access the areas of proposed construction through the existing roadway. The surveyor will place work limit stakes prior to any work commencing, in accordance with the approved plan. The contractor shall provide a silt fence, backed by coir logs as needed. The pool hole will be excavated, and the pool and patio will be constructed. The septic system will be installed and then final grading and landscaping including the pool fence will be installed. The silt barrier will not be removed until the site is fully stabilized. Alternatives Analysis The site could be left as is, but the owners would like to install a pool. All work has been kept outside of the W buffer to the IVW and the pool is proposed as close to the existing dwelling as reasonably feasible.
