This looks to me like a combination of after-the-fact and new work and I would suggest presenting it in this way. The
RDA should be fine, given the extent of the proposed work, however, the original Order of Conditions for the
development of the property has not received a COC so a RCOC should be filed at the same time or first, so that the
Commission can review the new request in the right context.

Hello Kelly, I have my staff working on the RDA. A small portion of previous work - that we are filing with ZBA on – was
within the 50’-100’ buffer. I was not planning to do this as an after the fact filing as it was outside the 50’ but wanted to
be sure so I get it right. The area disturbed went from lawn to Bit. Pavement and a portion will be returned to lawn as
shown in the shade areas in front of the building towards 28. The other shaded areas are proposed Bit. Pavement
removal.
Please confirm an RDA is okay to file and not an after the fact RDA.
