HomeMy WebLinkAbout668 Route 28 SPR Comments 060821 w DRCFormal__X___ Informal_____ Review SITE PLAN REVIEW COMMENT SHEET Date: June 8, 2021 New Map: 32 New Lot: 91 Applicant: Gerald Manning (Captain Parker’s Pub) Location: 668 Route 28, West Yarmouth Zone: B2 Persons Present: Mark Grylls, Building Laurie Ruszala, Water Brian Yergatian, BSC Group Kathy Williams, Planning Kelly Grant, Conservation Gerry Manning, Capt Parkers Kevin Huck, Fire Amanda Lima, Engineering Project Summary Expand the existing restaurant by enclosing a portion of the existing outdoor patio on the eastern side of the building and constructing a small addition on the western side of the restaurant to provide a waiting/checkout area for take-out customers. Comments Building: Property is located in the B-2 / VCOD 1 zoning district. Property is also located in the AE-11 flood zone. Depreciated value of the existing structure according to the town assessor database Vision is $236,200. Total value of the renovations not to exceed $118,099 or the entire structure will be required to meet flood zone compliance. The project may benefit from a private appraisal may help increase the depreciated value. Side setbacks in the B-2 zoning district are 25’. The proposed addition to the east appears to require relief from the ZBA in the form of a Variance based on the dimension of 15.2’ provided. All construction to comply with 780 CMR MSBC including 521 CMR, 2015 IEBC etc. Planning: The proposed building expansion blends nicely with the existing building. Although no in-lot or buffer trees are proposed as part of the improvements, the size of the existing subsurface wastewater systems makes it difficult to add any. Some existing pavement is proposed to be removed and seeded in the rear, consider adding a tree in the northeast corner. The Applicant was able to secure the small square of property along the eastern property line. The Zoning Compliance Table should be amended to reflect the changes related to this additional parcel, including yard setbacks. The west elevation shows take-out windows, but no room on the site plan is available for people to access the windows. The applicant indicated that no take out would be served through these windows. Should the proposed building expansion door need to be handicapped accessible, it may be difficult to create a handicap ramp without impacting the existing handicap spaces. This ramp would need to be designed to accommodate the required handicapped spaces. Design Review: Refer to the attached April 28, 2021 Design Review Comment Sheet. Conservation: The proposed work is jurisdictional under the Wetlands Protection Act regulations 310 CMR 10:00 (Riverfront Area and land subject to coastal storm flowage) and the Yarmouth Wetland Protection bylaw Chapter 143 (land subject to coastal storm flowage). Under 310 CMR 10.58(5) the proposed work is considered redevelopment. Work to redevelop previously developed riverfront area must meet the criteria of 10.58(5). Work within land subject to coastal storm flowage must protect the interests of the Act and the Bylaw. A Notice of Intent should be filed with the Conservation Commission to review the project. Engineering: Fire: Yarmouth Fire Department supports the application, subject to applicable submissions, permits and inspections. Health: Water: It appears that the project has no impacts on the water service.
