VARIANCE REQUEST
50 ALMS HOUSE ROAD, YARMOUTH
This property is a 13,613+/- sf parcel located in the middle of Conservation Land. On this site
was a duck blind that had been there for years. In June 1986, an Order of Conditions was issued
(SE83-698) to allow the construction of a single family, 2-bedroom dwelling to replace the old
duck blind. The dwelling was built in 1987 and is assessed as being 1,434 sf consisting of 2
bedrooms and a den as well as a kitchen, living room and 2 bathrooms. Consequently, DEQE
considers this property a 3-bedroom dwelling as they consider the den to meet the criteria of a
bedroom. There is a Certificate of Compliance issued in July 1989. This parcel is not only in an
area of “Land Subject to Coastal Storm Flowage” it is also in the AE EL12/AE EL13 and VE
EL14 Flood Hazard Zones. It is also subject to wave action and partially within the Coastal
Barrier Resource System (CBRS). It is totally within flood zoning and surrounded by wetland
and resource areas.
This NOI is to upgrade the existing failed septic system and installation of a new potable water
well only. Any additional site work is not included with this NOI. The septic system failed an
inspection and the well that supplies water to the house is not potable at this time as is evident by
the two independent tests performed (attached). Without drinking water, the property would be
condemned as uninhabitable. We are proposing a new I/A septic system and a new deep well be
drilled to supply water to the house. The I/A Singulair system is a system that will be more
environmentally friendly in helping to reduce the nitrogen output into the ground.
Due to the lot’s constraints, it’s impossible for the proposed new well to meet the no disturb
areas for the Town’s Wetland Bylaw. Per Part 2, Section 2.06(3)(a). “Minor structures (up to
140 sq ft) may be closer than 50’ but not closer than 35’…” We seek a variance, to allow the
new well to be 10’ from the salt marsh due to no feasible alternative to the proposed well
location and for the safety of the inhabitants of the property. The location was chosen as it’s in
the same location (per owners) as the existing well and to reduce damage the well drilling
equipment may cause. It is a sizeable truck and its movement would create damage.
We request a variance from Part 2, Section 2.10 Land Subject to Coastal Storm Flowage (3)(a).
Neither the proposed new septic system and the proposed new well can meet the required
distances of 100’ from a BVW, nor the State Title 5 Code 15.211(1) Minimum Setback Distance
of 100’ and the Town of Yarmouth’s Well Regulation 3.7 Distances & Location of Disposal
Facilities regarding the distance of 150’ between the well and the leaching facility as well as the
distances of the leaching to the wetland and resource areas. Therefore, we are requesting the
necessary variances per the Town of Yarmouth Wetland Bylaw Part 4. Variance, section 4.01(1).
We will be requesting variance from the Board of Health and the Town of Yarmouth septic
regulations for the necessary variances to upgrade the septic and install a new well.
The work done to the site shall not be done during the timing of a full moon or high tide.
The site plan shows the installation of silt fencing and straw bales to prevent silts from escaping
into the resource areas.
All caution should be used to not disturb the lot to the largest extent possible. Any areas that
have been disturbed shall be returned to the pre-construction condition.
EQUIPMENT SCHEDULE
Equipment to be utilized include:
A pump truck, an Excavator, loader, dump & other specialized trucks, well drilling
equipment, power and hand tools and additional equipment/tools, dumpster, port a potty as may
be necessary.
CONSTRUCTION PROTOCOL
Placement of the silt fence and straw bale work limit to be set prior to the commencement of any
construction. Notification to the Conservation Agent that it’s in place for the inspection.
We propose a 2-phase project. The well installation would be Phase 1 followed by the septic
installation.
Stake the well location as well as the leaching facility for proper placement
Silt fence may be removed only to provide an access and only as wide as is necessary to provide
the access to the well location, but shall be replaced the end of each day.
Well drill rig to drill new well. Install well liner, hook up to waterline to the house.
Clean up site from any debris to leave site in order prior to vacating site.
Septic installer to access property for the installation of the new septic.
Existing septic components to be pumped and removed from site including polluted soils.
Excavation for new septic system to meet the distances shown on the plan.
Installation of the septic system including I/A components.
Inspections of the system with partial backfilling.
Start-up of I/A system and inspection followed by final grading.
Revegetation of site and disturbed areas
Additional Instructions:
No stockpile of soil may be left on site
No motorized equipment, port a potty or dumpster shall be left on site during a Coastal Storm
Event.
