HomeMy WebLinkAbout10-26-21 SPRFormal X Informal Review SITE PLAN REVIEW COMMENT SHEET Date: October 26, 2021 New Map: 36 New Lot: 93 Applicant: Cape Cod Hospital Location: 4 Ba view Street, West Yarmouth Zone: B1/R25 Persons Present: Amanda Lima Brian Yer atian KathyWilliams Daniel Serber Mark Grylls Kelly Grant Project Summary Construction of carports within the existing parking lot, to support the installation of an approximately 2.35 mW (dc) solar photovoltaic array. The project also entails the construction of three (3) concrete equipment pads, four (4) utility poles, electrical service and landscaping. The project also requires the removal of several light poles within the existing parking lot. All existing in -lot trees will be preserved. Comments Building: Project is located in the B-1 1 R-25 and APD overlay districts. Current configuration has been granted various decisions for zoning relief over the years. In particular, Petition #'s 2405, 3899, 4354, and 4715 to create the parking areas. Applicant should review the previous relief and identify which sections require modification and which sections may require new relief. While solar uses are "protected" via the so called Dover amendment, the structures themselves are not protected from reasonable regulation as described in MGL CH 40a. Most notably, there does not appear to be a primary structure on the lots. Section 500, Definitions states the following: ACCESSORY STRUCTURE — A structure customarily incidental to and located on the same lot with the principle structure, or on contiguous lots held under the same ownership. If ownership record does not indicate that the adjoining parcel is under the same ownership, and has a primary structure, relief in the form of a SP & or variance for current configuration may be necessary. This should be discussed further prior to application with the ZBA. The westerly structure in canopy #5 appears to be in the front setback. The lot shape makes it difficult to fit in the bylaw. The applicant may file for a different determination from the ZBA, however, the lot line follows the same plane as the front lot lines along Beyview St. In lot trees that are a bylaw requirement as well as part of the previous decisions may be impacted by the location of the canopies located around them. Lighting plan required at time of ZBA application. Battery packs located in the APD, relief from ZBA for this location. Planning: The canopies are proposed to be installed around the existing in -lot trees within the parking area, with the applicant noting that no existing trees will be impacted. Many of the trees are shorter in size at this time with the canopy heights ranging from 1 T to 23', depending on the style and size. It is unclear whether the existing trees, or replacement trees, will get enough sun light to survive. The Town Tree Warden has been contacted, but have not received his input at the time of this meeting. Recommend some input from an arborist regarding the survivability of the trees. The canopies of the full grown trees may impact the efficiency of the solar panels and there should not be include excessive pruning. Replace existing dead, dying or missing trees. Relocate the equipment pad blocking the gate on the northern end of the property to ensure a second access to the parking area. Conservation The property and a portion of the work falls within the jurisdiction of the Wetlands Protection Regulations 310CMR 10.00 and Yarmouth Wetlands Protection Bylaw Chapter 143. Work is within the 50-100 foot buffer and land subject to coastal storm flowage. The extent of proposed ground disturbance will determine the level of permitting required. What is the total proposed ground disturbance? Are there changes proposed to drainage characteristics? Notes of the plan indicate significant ground disturbance. The work may be jurisdictional under the Town of Yarmouth Stormwater Regulations, Chapter 145, if ground disturbance is greater than one acre. Design Review: Refer to the attached September 16, 2021 Design Review Committee Comments. The SPR plans do include 5 buffer trees on the west side. Any dead, dying or missing trees should be replaced. Engineering: 1. Perspective Photos a. The pitch of the canopies appear to discharge stormwater runoff including snow and/or ice formation towards the vehicles. Please confirm that is the intention. Sheet 2 show the canopies extending past the vehicles. 2. Sheet 2 a. Confirmed that lighting be provided under the canopies. There is a call -out to remove and dispose of existing perimeter lighting. If lighting is modified, provide an updated lighting plan to building. Fire: Health: The Health Dept. has no issue with this project. Water: Read & Received by Applicant(s)
