Year Built: 1839 • Residence/Boarding house • over 75 years old • listed as a contributing structure in the SY/BR National Register Historic District • subject to Demolition Delay Inquiry 3 Aug 12, 2019: Received an inquiry from Joseph Dick regarding the process for YHC approval for partial demo and rebuild. Site Visit Sept S, 2019: YHC to tour property with Joseph Dick to gather information to make "significant" determination. YHC Meeting Sept 12, 2019 YHC to meet in quorum to discuss site visit and vote on "significant" determination. DEMOLITION DELAY PROCEDURE For all buildings over 75yrs old (located outside of the OKH Regional District) and for all buildings listed in the South Yarmouth/Bass River National Register Historic District. Applicant to deliver a copy of the Building Departments Demolition Permit Application, signed by the owner of record, along with a completed "Notice of Intent to Demolish a Historic Building" form to the Building Department and/or Historical Commission which prompts the Historic Properties bylaw process. Within 10 business days, Historic Commission to determine whether building/structure is "Significant": Is associated with one or more historic persons or events contributing to the cultural, political, economic or social history of the Town or the commonwealth. or Is historically or architecturoliy important (in terms of period, style, method of construction, or association with a famous architect or builder), either by itself or in the context of o group of buildings or structures. Significant Historical Commission notifies the Building Commissioner, Town Clerk and Owner of Outcome NOT Significant Historical Commission provides notification to building Commissioner Demolition Permit may be issued The Commission shall hold a public hearing within 30 days after notification to Town Clerk, to determine if the demolition of this structure will be detrimental to the historical, cultural or architectural heritage or resources of the Town. Legal Notice to be made at least 14 days prior to and again within 7 days of said hearing. Notice is also provided to applicant. Detrimental Within 10 business days from the close of public hearing, the Historical Commission shall notify the applicant, Building Commissioner and Town Clerk of the decision and no demolition permit may be issued until: The Commission is satisfied that there is no reasonable likelihood that eitherthe owner or other person/group is willing to purchase, preserve, rehabilitate or restore the building. NOT Detrimental Within 10 business days from the close of public hearing, Commission shall notify the applicant, Building Commissioner and Town Clerk of the decision. Or 180 days have passed and the Commission is satisfied that owner made reasonable efforts (as evidenced by monthly progress reports) to locate a purchaser or preserve, Demolition Permit may qe issued rehabilitate or restore the building and that such efforts were unsuccessful. There are five exceptions to the definition of a meeting under the Open Meeting Law. 1. Members of a public body may conduct an on-site inspection of a project or program; however, they may not deliberate at such gatherings; 2. Members of a public body may attend a conference, training program or event; however, they may not deliberate at such gatherings; 3. Members of a public body may attend a meeting of another public body provided that they communicate only by open participation; however, they may not deliberate at such gatherings; 4. Meetings of quasi-judicial boards or commissions held solely to make decisions in an adjudicatory proceeding are not subject to the Open Meeting Law; and 5. Town Meetings, which are subject to other legal requirements, are not governed by the Open Meeting Law. See, e.g. G.L. c. 39, §§ 9, 10 (establishing procedures for Town Meeting). The Attorney General interprets the exemption for "quasi-judicial boards or commissions" to apply only to certain state "quasi-judicial" bodies and a very limited number of public bodies at other levels of government whose proceedings are specifically defined as "agencies" for purposes of G.L. c. 30A. We have received several inquiries about the exception for Town Meeting and whether it applies to meetings outside of a Town Meeting session by Town Meeting members or Town Meeting committees or to deliberation by members of a public body —such as a board of selectmen — during a session of Town Meeting. The Attorney General interprets this exemption to mean that the Open Meeting Law does not reach any aspect of Town Meeting. Therefore, 71 a F e
