The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners’ packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) 1 original application with original signatures (double sided). A comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other supporting information. 1 original and 7 copies of the plan, folded separately, right side out with title visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. A 100’ radius map, current abutters list and abutters notification identifying the property owners who are to be notified per 310 CMR 10.00. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. A pdf copy of signed application, supporting information, and plan emailed to kgrant@yarmouth.ma.us. Please list project property’s street address in the pdf file name. Submit Certified Mail Receipts (PS Form 3800) for all abutters. Submit Certified Mail Receipts for Massachusetts Natural Heritage and Endangered Species Program and Massachusetts Division of Marine Fisheries. Notice of Intent 202 Pleasant Street South Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project located at 202 Pleasant Street (the Site) in South Yarmouth, MA involves the addition of a jet ski lift to an existing pier within the Bass River, which will utilize existing support pilings (the Project). This application is being submitted in accordance with the Town of Yarmouth Wetlands Protection Bylaw (the Yarmouth Bylaw) and Massachusetts Wetlands Protection Act and associated regulations (the WPA). 2.0 SITE DESCRIPTION The property located at 202 Pleasant Street contains a single-family home bordered by single family homes north, east, and west with the Bass River to the south. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include: • Land Under Ocean • Shellfish Habitat • Riverfront Area (Bass River) • Salt Marsh • Coastal Bank • Land Subject to Coastal Storm Flowage, Zone AE (Elevation 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Proposed Jet Ski Lift: The proposed project will have a proposed 10’ x 13’ jet ski lift for 2 jet skis which will use existing support pilings associated with the existing pier. The existing pier is permitted under license number #3352, dated June 30, 1993, Plan Book 496, Page 3 & 4, Deed Book 8691, Page 121. The existing pier is 76’ away from the existing 100’ wide channel location of Bass River, however the proposed jet ski lift will be installed on the end of the pier, on the southern side. The installation of the jet ski life will not require the disturbance of any sediment in Land Under Ocean associated with the Bass River, therefore no adverse impacts to jurisdictional resource areas are anticipated as a result of this work. 4.0 MITIGATION Proposed work is not anticipated to have any adverse impacts on Land Under Ocean or Shellfish Habitat because no ground disturbance is being proposed. The installation of the jet ski lift can occur at a mid to high tide to avoid potential scouring from the vessel that will be used to install the jet ski lift. A shellfish survey was conducted in the surrounding area, however very few shellfish were found within the depth at which the jet ski lift will be installed. The purpose of the survey was to evaluate shellfish habitat, shellfish species, and shellfish population density during a resource area evaluation of the shellfish habitat within the proposed project area of a minor modification to existing float and ramp within Bass River. This shellfish survey accompanies a Notice of Intent for 202 Pleasant Street, South Yarmouth, MA. 2.0 SITE DESCRIPTION The portion of the Bass River on which the project site is located roughly .6 miles from the mouth of the Bass River which flows into Nantucket Sound. Abutting the property are several single- family homes, located along the shoreline, some with piers, ramps and floats. The following resource areas are located onsite: • Land Under the Ocean • Land Containing Shellfish • Salt Marsh • Riverfront Area (Bass River) • Coastal Bank • Land Subject to Coastal Storm Flowage (LSCSF) 3.0 SHELLFISH INVENTORY In order to evaluate existing shellfish habitat at the site, BSC conducted a shellfish survey from the Mean Highwater (MHW) to below Mean Low Water (MLW). The weather during the survey was overcast with temperatures in the mid 50’s. The survey commenced as the tide approached MLW and was completed as the tide began to rise above MLW toward MHW. In order to sample for shellfish within the project area, 7 transects, located 8 feet apart (plus the distance between 4- foot wide excavated plots, resulting in a 12 distance between transects), each with 9 plots, located 10 feet apart (beginning from the edge of the 4-foot by 4-foot plot, resulting in a distance of roughly 14 feet between plots), were conducted as follows: Transect 1 – Located 12 feet (including the distance between 4-foot wide excavated plots, resulting in a 12-foot distance between transects) to the north of pier. Extending roughly 112 feet seaward from MHW. Transect 2 – Located at roughly along the centerline of the existing pier. Extending 112 feet seaward from MHW. Transect 3 – Located 12 feet to the south of pier. Extending roughly 112 feet seaward from MHW. Transect 4 – Located 24 feet to the south of pier. Extending roughly 112 feet seaward from MHW. Transect 5 – Located 36 feet to the south of pier. Extending roughly 112 feet seaward from MHW. Transect 7 – Located 60 feet to the south of pier. Extending roughly 112 feet seaward from MHW. Typically, plots would extend at least 30 feet beyond the farthest float, ramp, or other structure associated with an existing or proposed pier/dock. However, beyond roughly 112 feet, the depths and sediment conditions (being mucky) were too great for the safety of the shellfish surveyors. Further, transects were extended along the entire Bass River facing property line but stopped at the southern property edge. In all transects, Plots #1 and #2 were within salt marsh or areas of beach underlain with peat and sparse salt marsh grasses, therefore these areas were only visually inspected. Plots #3 - #9 were sampled between the intertidal beach and Land Under Ocean within the Bass River. Each plot was excavated to sample for shellfish using either a standard Clam Rake, Quahog Rake, or visual inspection (used only in areas of salt marsh or mussel beds). Each shellfish discovered in the plot was counted then replaced back into the plot from which it came from. Sparse clumps of Ribbed Mussels (Geukensia demissa) were noted in the Salt Marsh located on Site, but no Ribbed Mussels were found within or adjacent to any sampling plots. Oyster, Softshell clams (Mya arenaria), and Quahog (Mercanaria mercenaria) shells (deceased/empty) were found within the intertidal area. 4.0 TEMPORARY IMPACTS Proposed work related to the proposed minor modifications to the existing ramp and floats could have temporary minor impacts (turbidity) on the intertidal area and Land Under the Ocean, but overall would have very limited impacts on shellfish due to the low population density and through the observance of appropriate seasonal timing. Shellfish Survey 202 Pleasant Street South Yarmouth, Massachusetts 5 The proposed work could occur during the fall/winter/early spring months when shellfish life cycle activity is reduced. During the winter, shellfish live at increased depths in the tidal bottom with reduced metabolism. Therefore, only minimal impacts to shellfish habitat are expected (pilings). It should be noted that shellfish were found under the existing pier/float system, documenting that the structure is not impacting shellfish. Pile driving work should occur from a barge at mid to high tide to prevent the barge from running aground. If necessary, existing shellfish could be dug and relocated from the site. However, based on this shellfish survey this should not be necessary since a small population of shellfish were located near the work area. 5.0 SUMMARY BSC’s shellfish survey identified the following: Only 1 Quahog (Mercenaria mercenaria) was found across all 63 plots. This low population is likely the result of highly rocky/gravelly substrate, which results in poor habitat quality for this species. In addition, no spat or seeds were noted across the surveyed area. The salt marsh located along the entire seaward edge of the Site begins at the base of the revetment wall and extends roughly 16 feet seaward within the intertidal beach. These areas sparse populations of Ribbed Mussels, but no population of Ribbed Mussels were noted within excavated plots.
