PETITIONER REQUESTS: The petitioner requests a special permit to allow to store two cars inside building and sell autos out of building. MEMBERS OF THE BOARD PRESENT AND VOTING: Leslie Campbell, Chairman, Fritz Lindquist, David Reid, John Richards. It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all those owners of property deemed by the Board to be affected thereby and that public notice of such hearing having been given by publication in the Yarmouth Sun, the hearing was opened and held on the date first above written. The petitioner requests a special permit, per §202.5 for use H4, and per §406, so as to allow a portion of this existing building to be used for the storage of up to two vehicles, within the building, and the sale of used motor vehicles from the site. The site, located on Huntington Avenue, South Yarmouth, is in the Industrial Zone. It is presently improved with a one-story commercial building, which has for scrre tirre housed an Electrical Contractor's office/shop. (see permit n2769-5) The petitioner proposes to use the space measuring approximately 20' x 40' at the northerly end of the building. This area will supply indoor storage of up to two automobiles, as well as a small office area for the petitioner's use. The petitioner will secure from the Town a Used Car Sales License, and will conduct his business from this site. Hou-ever, he represents that his business will be ccnrduz.ed pr_, --il� off rrc-•_ses. There will be no employees on the site (other then the petitioner). There will be no washing, detailing, body work, service, repair or maintenance of the vehicles on site. The use, H4, is allowed in the district by special permit. The Board is satisfied that this use may be Trade without causing any undue nuisance, hazard or congestion and without causing any substantial harm to the established or future character of this neighborhood. As for 5406, the petitioner represents that he will not store or use any hazardous materials on the site. Use H4 is not allowed in the A.P.D., however. The Building Inspector indicates to the Board that use H4 is the correct category for used car sales, however, the actual r use and activity of the petitioner, in this instance, is really an office use. There will not be any cleaning, repair or maintenance etc. of the vehicles on the site. In fact, most of the petitioner's "business" will be conducted off -site. Therefore, for purposes of of the APD/§406 concerns, the use is more accurately considered as an office use with incidental sales and parking of two (2) vehicles (use L2/Q2/G1). Therefore, within the limitations represented by the petit-ioner, the Board is•satisfied•that the use may be made within the purposes and intention of §406. This conclusion is consistent with the recommendations of the Board of Health/Hazardous V7aste Inspector's report to the Board, by letter of January -13, 1994. Therefore, a Motion was made by Mr. Lindquist, seconded by Mr. Richards, to grant the special permits, pursuant to §202.5 and 5406, as requested on the conditions that (1) there be not more than two (2) vehicles (available for sale or in inventory) stored on the premises at any time, which vehicles will be stored inside the building (2) that there be no washing, maintenance, repairs, etc. of the vehicles on site (3) that there be no use or storage of hazardous materials on site. The Board members present voted unanimously in favor of this Motion. The special permits are therefore granted. No permit shall issue until the passing of 20 days from the filing of this decision with the Town Clerk. David S.
