Discussion of proposed activity
The Conservation Commission issued a Determination of Applicability dated March 8, 2017 (attached) for the construction of a portion of a driveway, removal of a boulder, and installation
of utilities at 63 Thacher Shore Road, Yarmouthport, MA. The project has not been started and the Applicant seeks to reinstate the Negative Determination; he missed the opportunity
to extend the Determination by a few days.
Only the beginning portion of the driveway falls within Conservation Commission jurisdiction. Land subject to coastal storm flowage, bordering vegetated wetland (and salt marsh), and
a coastal bank are located across Thacher Shore Road, so that all work is proposed in the buffer zone to the coastal resource areas. The driveway will access a proposed single-family
dwelling to be constructed beyond Commission jurisdiction, further than 500 feet from the resource areas. The Applicant requests approval of the December 16, 2016 plan that was cited
in the previously issued Determination. There have been no changes in the resource area delineations or the proposed construction.
The existing dirt way will be improved with gravel as shown in the Section detail. A west to east equalizer pipe is to be installed under the drive to accommodate for seasonal water
within the drainage area of the road.
The road accesses one single-family building lot and is considered a driveway. DEP Stormwater Management Standards do not apply either as the driveway services a single-family dwelling,
or the development project comprises four or fewer lots and stormwater discharge will not affect a critical area.
In addition, the total limit of disturbance for the driveway and house construction is 33,900 square feet, less than the 1-acre threshold to require a Stormwater Management Permit under
the Town of Yarmouth Stormwater Management Regulations – see attached plan.
An existing boulder is blocking the drive entrance and is proposed to be removed. Utilities for the house are to be installed within the driveway footprint. Disturbed areas along the
driveway are to be seeded with a conservation mix, underlain with 4” of loam.
