Enclosed is the Lot Determination for 6 Merrymount Road, West Yarmouth, aka Parcel 91, shown on
Assessors Map 23. Upon reviewing the zoning chronology and ownership history, I have determined this
lot is not protected pursuant to the provisions of MGL Chapter 40A, Section 6, Common Lot protection
and Town of Yarmouth Zoning Bylaw Section 104.4.4, para. 1, 2 and 5 for the following reasons:
-The lot was created in January, 1926. That plan shows the lot as No. 2, containing 9,600 square feet of
land area and 80 feet of frontage.
-Based on the Town of Yarmouth Zoning changes, I find that the minimum land area for that location
increased to 10,000 square feet on March 7, 1960.
-The Assessors records reflect the following ownership information:
Parcel 81(lot 2)
*A conveyance was made from a Nils F. Anderson to Eleanore M. Townsend/Eleanor Murray Brown on
February 8, 1961
Parcel 60 (lot 19)
*A conveyance was made from a Grace P Boeske to Eleanore M. Townsend/Eleanor Murray Brown on
January 9, 1961.
Based on these facts, I now find that the lot in question was held in separate ownership on the date it
became non -conforming and then was conveyed into common ownership after that time frame.
Accordingly, it lost its protection and does not conform to the General Law and Zoning Bylaw provisions
stated above. Unfortunately, the August 8, 2018 determination did not take into account the correct non-
conforming date.
