Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners
of property as required by law, and to the public by posting notice of the hearing and publishing in
The Cape Cod Times, the hearing opened and held on the date stated above.
The petitioners are Jack and Audrey Lee of 43 Autumn Drive, South Yarmouth, MA
property in an R-40 Zoning District. Noteworthy is that a similar petition was heard previously
by the Board with a general consensus that the relief sought could not be granted. This occurred
in December,202l. Nevertheless, the applicant seeks a special permit pursuant to By-Law
5202.5, Footnote 5 and in connection with the desire to construct a two-car detached garage
resulting in four parking bays within two structures. The petitioners were well represented by
their daughter and a representative of Ferullo Remodeling. There was no substantial change to
the structure which the petitioners seek to construct from the structure previously considered by
the Board. The Board expressed a general consensus that they could not support the petition.
After discussion, the petitioner's representatives requested that the Petition be allowed to be
withdrawn, without prejudice. A motion was made and seconded to grant the request for the
allowance of the withdrawal of the petition which, upon a roll call vote, was voted in favor and
the petition was, therefore, allowed to be withdrawn, without prejudice.
