The petitioners are Jack and Audrey Lee of 43 Autumn Drive, South Yarmouth, MA property in an R-40 Zoning District. Noteworthy is that a similar petition was heard previously by the Board with a general consensus that the relief sought could not be granted. This occurred in December,202l. Nevertheless, the applicant seeks a special permit pursuant to By-Law 5202.5, Footnote 5 and in connection with the desire to construct a two-car detached garage resulting in four parking bays within two structures. The petitioners were well represented by their daughter and a representative of Ferullo Remodeling. There was no substantial change to the structure which the petitioners seek to construct from the structure previously considered by the Board. The Board expressed a general consensus that they could not support the petition. After discussion, the petitioner's representatives requested that the Petition be allowed to be withdrawn, without prejudice. A motion was made and seconded to grant the request for the allowance of the withdrawal of the petition which, upon a roll call vote, was voted in favor and the petition was, therefore, allowed to be withdrawn, without prejudice. *"*"'{H*sEh_ Steven DeYoung, Chairman
