In accordance with M.G.L., ch. 41, §81-W, it is hereby certified by the Planning Board of
the Town of Yarmouth, Massachusetts, that at a duly called and properly posted
meeting of said Planning Board, advertised in The Register newspaper on Thursday
June 1, 2017 and Thursday June 8, 2017, and held on Wednesday, June 21, 2017, the
Board voted to modify its approval of Definitive Subdivision Plan #1648H entitled
"DEFINITIVE SUBDIVISION PLAN OF LAND IN YARMOUTH PORT, MA PREPARED
FOR DAVID SWIFT', prepared by Arne H. Ojala, P.L.S., of Down Cape Engineering,
Inc, Yarmouth Port, MA, dated May 3, 2005 and recorded at the Barnstable County
Registry of Deeds, Plan Book 601, Page 49.
Said modifications extend the time period for construction of the roadway and utilities by
an additional four (4) years and grant a waiver to allow for the installation of electric and
cable service through an easement over property located at #138 Route 6A, rather than
be located within the road right-of-way, as shown on the plan entitled, "DEFINITIVE
SUBDIVISION PLAN OF LAND IN YARMOUTH PORT, MA PREPARED FOR DAVID
SWIFT, prepared by Daniel A. Ojala, P.L.S., of Down Cape Engineering, Inc, Yarmouth
Port, MA and dated May 5, 2017 and revised June 21, 2017. The proposed changes do
not modify the roadway layout or the dimensions of the single lot created by Definitive
Subdivision Plan #1648H.
Planning Board approval of the requested modification is conditional. Those conditions
and all waivers granted are outlined in an Agreement document to be recorded by the
petitioner at the Barnstable County Registry of Deeds.
