The Yarmouth Board of Health is in receipt of your application requesting a variance from t
State Environmental Code's Title 5 and/or Town of Yarmouth Amendments to Title 5. Phis
of the septic system arc on file, for review, at the Health Department Office.
DESCRIPTION OF REQUESTED VARIANCE(S):
Variances requested are to upgrade existing cesspools to Title V to
service an existing dwelling.

Engineered site plan prepared by Land Use Technology, Inc. , dated 2/11/93
and revised is on file at this department and available for public review.
The hearing originally scheduled for April 26, 1993, then postponed to
May 3, 1993, has been rescheduled for May 17, 1993 due to a scheduling
conflict by Land Use Technology, Inc.
Please be advised that the Yarmouth Board of Health will conduct a Hearing for the above
requested variance(s) on: May 17, 1993 at 7:45 r.m. in
the Lower Meeting Room of the Town Office Bldg., Route 2S, South Yarmouth, MA.
NOTE: The Engineer, whose stamp appears on the prepared plan(s), must be present at the
Board of Health Meeting.

The Ya ,. uth Board of Health, having reviewed your application cn _ May 17, 1993 ,
fcr a variance frcm the provisions of Regulation cf Title v of the
State Environmental Code and/er from the Tc:n of Yarmouth Amendments to Title V, Eecticn
3.7 , for a subsurface Sewage Disposal System and, having determined
strict enforcement of these regulations in this instance would do manifest injustice
and, further, that your requested variance does not ccnflict with the spirit of the
State Environmental Code nor the Tcwn of Yarmouth Amendments, has hereby Granted the
variance(s) which shall become effective thirty (30) days after the Department of
Environmental Prctecticn ( D.E.P. ) begins review of the requested variance(s) . Please be
advised, that in acccrdance with 310 CMR 4.0 ycu must prcperly aroly to the Department
of Environmental Prctecticn to activate their review cf this Board of Health acticn. The
Department of Environmental Prctecticn will advise ycu of the beginning of the thirty
(30) day review time frame and comment thereafter. The variance(s) cranted are as
follows: Variances are approved to upgrade existing cesspools to Title V to service an
existing dwelling as shown on the engineered site plan prepared by Land Use Technology,
Inc. , dated 2/11/93 and revised 3/22/93.
Variance approved with the condition of an annual well test and notifying tenants
of well test results.
SEE ATTACH VARIANCES REQUESTED
Ycu are further advised that no work shall be ccirrenced under this variance until the
elapse cf the thirty (30) day filing period with the Department cf Environmental
Protecticn. The variance(s) cranted herein shall expire ninety (90) days frcm the date
that the D.E.P.— irty (30) day review time frame terminates.
