The property was sold to Nancy and Kenneth Leeser on September 18, 2020, who are seeking a Certificate of Compliance for the construction. Hamlyn Consulting was retained in 2021 to file a request for a Certificate of Compliance with the Yarmouth Conservation Commission. During the site inspection, it was noted that the mitigation plantings had not been installed. The area where the native shrubs had been proposed was being encroached upon by aggressive phragmites growth, so I asked the Conservation Administrator if the plantings could be relocated further to the south, still adjacent to the undisturbed buffer of the wetland, but in an area of somewhat higher elevation where the phragmites were not as inundating. Ms. Grant met with me onsite and approved the relocation. I then met the contractors on the property to ensure the shrubs complied with the species, number and location cited and approved. Roof run-off is directed into stone areas or below grade. There has been no encroachment into the buffer zone beyond the approved limit of work. One deviation from the approved Site Plan is the construction of a retaining wall instead of the proposed slope associated with the regarding for the septic system. The wall is located a minimum of 84 feet from the wetland. Daniel Ojala, P.E., P.L.S., the project engineer, inspected the property and prepared -the attached As -Built Sketch Plan. Mr. Ojala's signature is included on this letter request. As the project is in substantial compliance with the Order of Conditions and the approved plan, the Applicant requests that a Certificate of Compliance be issued at this time.
