Dear Commission Members:
On behalf of the Applicant, Two Twenty Five White’s Path Units Two and Three LLC CHA Consulting, Inc.
is pleased to submit the enclosed Stormwater Management Permit Application and supporting
documents associated with the proposed Alteration to Warehouse and Distribution Center project
located at 225 White’s Path. The project purpose is to modernize the existing warehouse/distribution
center building and site as described in more detail below.
The project site consists of a large single parcel of land containing 17.7 acres. The parcel is located
within the Business District, B-3 and Watershed Protection Overlay district. No change in use of the
property is proposed. No portion of the project occurs within a FEMA 100-year floodplain (Zone X). A
review of the Massachusetts Natural Heritage Endangered Species Program (NHESP) GIS data layer
indicate that there are no Estimated/Priority habitats or rare-listed wetland, or upland wildlife or
vegetation designated within the project vicinity, including vernal pools. There are no onsite wetland
resource areas or offsite wetland resource areas within 100’ of the property, nor other special resource
areas including Area of Critical Environmental Concern (ACEC) or Outstanding Resource waters (ORW).
The site is improved with an existing single-story steel and masonry building approximately 156,000
square feet in size. The building is subdivided into three (3) condominium units. Unit 1 contains
approximately 46,000 square feet and comprises the front portion of the building. Unit 2 contains
approximately 42,500 square feet and Unit 3 contains approximately 37,500 square feet comprise the
remaining portion of the building. Units 2 and Unit 3 together comprise the project premises, Unit 1 is
not part of the proposed project.
Access to the site is gained from a single driveway entrance from White’s Path, located in the northwest
corner of the site. Paved parking and loading areas are in the westerly portion of the site, adjacent to
the centrally located building. The remaining portions of the site consist of naturally wooded and
landscaped areas.
The proposed project will modernize the interiors of Units 2 and 3 to better serve the
warehouse/distribution use, including new van loading area, screening area, and staff support and
administrative spaces. Two (2) vehicular ramps are proposed to provide access to interior parking and to
facilitate sorting and loading of packaging. No changes to the footprint of the building or to the overall
area of the building are proposed.
Site improvements proposed include new paved parking for vans, paved areas reserved for trailers and
automobile parking. The single driveway access from White’s Path will continue to be used without
alteration. Moreover, there are no changes proposed to the existing access and parking/loading facilities
from White’s Path to a point approximately 450 feet into the site as this area is generally reserved for
Unit 1. The proposed improvements have been positioned on the site to provide considerable natural or
landscaped buffers to adjacent properties. In lot trees and perimeter trees are proposed to enhance
screening. Existing and new paved surfaces will be striped and site lighting will be installed in
conformance with the Town’s requirements for mounting height and intensity.
Stormwater management improvements are proposed, incorporating deep sump/hooded catch basins,
oil/grit separators, water quality units, and a replacement retention/recharge basin. These best
management practices will improve water quality and provide treatment, flood control and
groundwater recharge. Refer to the attached Stormwater Report and Project Plans for a detailed
description of the stormwater management improvements that are proposed as part of this project.
In accordance with Section 145 of the Code of the Town of Yarmouth, the proposed project will require
a Stormwater Management Permit as the project will disturb land area equal to or greater than one (1)
acre. The project has recently been reviewed by the Town of Yarmouth Site Plan Review Team and
comments received are included in this Stormwater Management Permit application. Approval has also
been received from the Cape Cod Commission for a Minor Modification of their 1992 Development of
Regional Impact Decision.

new information may be accepted into the Commissioners’ packets within the week before a

deficiencies to an applicant for an application within ten (10) business days of receiving the application.

Project Summary
Proposed project includes modernization of the interior space to better serve the warehousing/distribution use, including
an interior van loading space, a new screening area, and staff support spaces. On the exterior, 2 new vehicle access
ramps are proposed on the west façade of the building. Site improvements to include new paved area for 25 vans and 20
trailers, replacement of the infiltration basin and addition of water quality unit, landscaping and lighting.
Comments
Building: Project is located in the B-3 / APD overlay district. Applicant seeks to modify the structure to allow interior
parking / loading and an increase to the outdoor parking area. The original ZBA decision, #2856 allowed for F3, trucking
and warehousing use of the entire property.
Interior parking will likely require compliance with 248 CMR MA State Plumbing Gas Code, section 10.09 regarding floor
drains. Parking area upgrades appear to meet the standard of section 301 of the zoning bylaw. Stormwater Management
Permit through Con Com will be required.
All proposed construction to comply with 780 CMR and appendant codes.
Community Development and Planning: As some of the project components (parking for vans and tractor trailers) will
be occurring closer to the southern property line (Cape Cod Rail Trail and residential properties), applicant should ensure
robust screening and adequate noise attenuation from trucks backing up. Depending upon the thickness of the vegetation
to remain, supplemental plantings and or fencing may be required.
The minor modification to the Development of Regional Impact (DRI) submitted to the Cape Cod Commission (CCC)
included a traffic report showing that the project will not exceed the maximum traffic volumes outlined in the 1992 DRI
approval. However, the problem with allowing for traffic increases based on a DRI from 1992 is it doesn't take into
consideration the background increases that have happened over time. The analysis back in 1992 may have shown one
level of impact based on the proposed project traffic increases, but the impacts will be much more exacerbated based on
our increased traffic levels over the past 30 years. Applicant should adhere to the amended DRI requirements including
implementing the Transportation Demand Management (TDM) program and any ongoing traffic monitoring requirements
and provide the information to the Town.
Conservation: Not present. A stormwater permit is required from the Conservation Commission.
Design Review: Not present.
Engineering:
• Drainage
o Existing catch basins & piping to be retained shall be cleaned, inspected and repaired as needed.
o Tight tank location has close proximity to CB with RIM 36.8. Is it possible to relocate to an area that if
it overflew, then it wouldn't go into the drainage?
o What is the purpose of the drainage to the southern part of the property? DMH Rim 37.2 heading
east.
o Provide stormwater O&M plan as part of the stormwater submission to Conservation.
ire: Evaluation of fire alarm and sprinkler system by design professional. Carbon monoxide monitoring and
\ alarm evaluation. Access and signage for FDC. Early detection requirements for sprinkler activation. Acess and
training for fire department personnel. Requirement for interior standpipes.
Health:
c1-Toxic or Hazardous Materials
The project must comply with the Town of Yarmouth, Board of Health Regulation: Handling and Storage
of Toxic or Hazardous Materials, which includes, but is not limited to 150% volume secondary
containment of all toxic and hazardous materials and annual Board of Health licensing. The site plan
review application lists "None" beneath the heading "List of all Hazardous Materials and Quantities".
However, please consider the following areas and explain each with regard to toxic and hazardous
materials: (1) those that will pass through the facility; (2) those that will be used at the facility and (3)
those that will be stored at the facility. Some materials will overlap the aforementioned categories. Since
this project is a warehouse/distribution center please list what materials are not acceptable for receiving
and shipping. Please also provide a list of all toxic or hazardous materials along with the maximum
quantities of each that may be present at any time. Furthermore, if any toxic or hazardous materials are to
be handled please explain: (1) the damaged goods assessment, containerization and disposal program
and (2) the dangerous goods shipping program. Concerning toxic or hazardous materials that pass
through the facility please explain how such materials will (1) be provided secondary containment and (2)
be physically protected against threats such as vehicle strikes. The engineered plans depict new
proposed indoor vehicle parking and expanded outdoor vehicle parking. With this in mind please explain
whether or not vehicle fluids such as, but not limited to engine oil and windshield wash will be stored and
used onsite in support of the vehicle fleet. Please state whether or not vehicles used only indoor and
onsite such as forklifts will be propane powered.
Tight Tank
Drawing Number C-103, Site Grading and Drainage Plan, depicts a proposed tight beneath the parking
lot. Drawing Number C-602, Details-2, illustrates details of the system. Please explain the purpose of this
tank and whether or not it receives water from the indoor vehicle parking area. Note 10 references
Industrial Waste Water Holding Tank regulations. If this is the purpose of the tank please revise all
references to tight tank with holding tank. Please then revise the design to be in compliance with 314
CMR 18, which includes, but is not limited to secondary containment and leak detection.
Septic
Please elaborate on the use and occupancy number of the building including the expanded office areas
so that compliance with Title 5 septic regulations can be evaluated.
Solar Array
Please explain whether or not: (1) the solar panels contain any toxic or hazardous material within such
as, but limited to heat transfer fluid; (2) the electrical inverters contain any toxic or hazardous materials
such as but not limited to antifreeze or dielectric fluid and (3) any battery storage is present and list the
involved toxic or hazardous materials.
Water:
41,, Proposed 8' Landscape Screening on southern property line is located directly on top of water main. Please relocate
V screening a minimum of 10 feet from the water line. Please note the hydrant lateral to the hydrant located at the edge of
the south parking area is not shown. This lateral should be located and considered when relocating screening.
