Commission
The Yarmouth Conservation Commission received your Stormwater Permit Application for 225
White's Path, South Yarmouth on May 5, 2022, submitted under Town of Yarmouth By-law Chapter
145. As of this date, May 18, 2022, your application is deemed administratively complete.
The Conservation Commission has sought peer review services to assist with review of the
application. The Commission plans to engage consultant ESS Group, LLC to provide this service for
an initial estimated fee of $2,600. The scope of work and the associated costs are detailed in the
attached document for your information.
Please submit $2,600 in full to the Town of Yarmouth no later than ten (10) business days from this
notice. The fee must be received prior to the initiation of consulting services. Funds received
pursuant to M.G.L. Ch. 44 §53G shall be deposited with the Town of Yarmouth Treasurer, who shall
establish a special account for this purpose. The Commission may request additional fees if review
requires larger expenditure than originally anticipated or new information requires additional
consultant services.
The consultant has committed to having review comments available on or about June 9, 2022 if they
are authorized to begin work by May 25, 2022. To authorize the review, the peer review funds must
be submitted to the Town by May 24, 2022. This timeline would allow for the application to be
scheduled for the June 16, 2022 Conservation Commission meeting.

ATTACHMENT 1 — Peer Review Scope & Fee - ESS Group
SCOPE OF WORK
TASK 1: INITIAL TECHNICAL STORMWATER PEER REVIEW
ESS will provide a technical stormwater peer review of the Stormwater Management Permit Application
submitted for 225 White's Path, South Yarmouth. The review will include:
• Review for technically complete application - incomplete/inaccurate information needed to review the
application will be identified.
• Determination as to whether the proposed plans/BMPs meet the Stormwater Management
Regulations, effective July 1, 2021 .
• Identification of items to be modified for compliance.
• Recommended permit conditions, if applicable.
• A comment letter summarizing the findings of the review. The letter will be addressed to the
Conservation Commission (via the Conservation Administrator), and copied to the Town Engineer.
Deliverables:
• A single comment letter provided in PDF format.
ASSUMPTIONS
The proposed compensation described in this proposal is predicated on the Scope of Work described above
and the following assumptions:
• ESS will assume that all information provided to ESS by others is complete and accurate.
• To reduce costs and impacts to the environment associated with paper deliverables, ESS deliverables
will be provided in PDF format unless otherwise noted
COMPENSATION
The scope of work described in this proposal will be completed by ESS on a Time and Materials basis in
accordance with the ESS Standard Terms and Conditions and the current ESS Billing Rate Table.
This cost estimate was developed based on the information provided to ESS by the Conservation
Commission and the scope of work described above. Our estimated cost to provide the services described
in this proposal is $2,600. ESS will review additional submissions and responses to comments as requested,
for a supplemental fee.
