RE: 62/62A Silver Leaf Lane—Family Related Apartment.
Dear Mr. Chairman& Members of the Board:
BSC Group, Inc. (BSC) is pleased to request this application for Special Permit and/or
Variance for 62/62A Silver Leaf Lane in West Yarmouth to use the existing finished
basement apartment as a family related apartment.Presently the Building Department has
requested that the existing finished basement be vacated, and the unit is now empty.
At this time 2 forms of relief are required.
1.) To allow a family related apartment on a single-family lot.
2.) To allow a family related apartment greater than 800 s.f.
A short history in relation to the current basement:
The current owners of the property purchased the locus property in 1999 with a
finished apartment in the basement.
At that time,the current owners invited the Board of Health and Building
Department into the building to go through the building to confirm everything was
up to code.
The Building Department required egress from the two bedrooms and a building
permit was requested and issued on November 15, 2000, to install a"Scapewell" in
each bedroom. This allows egress from a basement bedroom in the event of

The floor plan submitted with this building application and on file with the Building
Department clearly depicts 2 bedrooms, a bathroom and a kitchen.
Once installation was complete,the Health Director,Mr Bruce Murphy and the
Building Inspector,Mr. Bill Stone signed off on the work.
In the Health Director's sign off dated 11/6/2000 he specifically mentions 5 Engineers
bedrooms in the house and "has existing kitchen downstairs—(2"1 kitchen in

Based on approval from the Health Department and the Building Department the
owners of the property have had the basement rented out since 2,001. Custom Software

similarly sized. The current finished space for the basement apartment is 1,008 s.f.

certain items in the basement to be code compliant.
Currently the bedrooms have two forms of egress and the apartment itself has two
forms of egress.
Since amnesty was being issued to on site apartments by the town in the late 2000's,
the Wards believed they were compliant since they had approval from both the
Building Department and the Health Department.
Based on the existing history of this property I believe it clearly depicts a continuous use of
the basement apartment that Mr. &Mrs.Ward felt was in full compliance with the
regulations.
