Dear Yarmouth Conservation Commissioners:
RE: PROPOSED REDEVELOPMENT OF RESIDENCE AT:
#2 Buttercap Ln Coastal Bank status–Yarmouth (119-33)
WITHIN the 50’ BUFFER ZONE OF A BVW and 100’ buffer zone (inner riparian zone) of a River
Dear Commissioners:
This is a project for construction of a new house and septic system an area within 50’ adjacent to a coastal bank
and 100’ inner riparian zone of a salt water river.
1) The house is a replacement for an existing home and the previous rendition and is 1355 SF vs 1112 SF
(original);
2) A new septic system replaces the existing system; and becomes it’s own mitigation
3) Accompanying mitigation planting for area changes to the placement and size of the house according to
Yarmouth rules and regulations; the new house is outside the 35’ no-build zone (35.5’);
4) The area is consistent with development within the neighborhood The proximity to the wetland edge
(BVW) and Riverfront area are shown on the plan. The applicant would like to mitigate the altering by
redevelopment;.
5) Some trees need to be removed (Locusts as invasive species, and being removed as it’s own mitigation.
some Pitch Pine for safety and /or proximity to each other; 1 Bl Oak for proximity to Septic system;
6) Trees removed are replaced with American Holly along the west property line which has invasives and
English Ivy;
PROJECT DESCRIPTION:
The goal is the redevelopment of a house compatible with Yarmouth Wetland Regulations. The proposed
remediation shall use reasonable parameters of size with appropriate mitigation. The total area of encroachment within
the 50’ buffer zone of this resource area buffer is listed in the accompanying table (on the Plan). It compares the amount
of deck/house within each of the 3 buffer areas from a coastal bank (the coastal bank is the more landward than the inner
riparian zone), which are: (1) 35’ no-build zone, (2) 50’ buffer, and (3) 100’ inner riparian zone. Removed pitch Pines
are being replaced by American Holly along west property line..
This mitigation planting follows the shape of the Top of Coastal Bank (TOCB) and seeks to create a vegetated
buffer and shrub layer protection for the coastal bank where invasive Locust trees are to be removed (roots remain).
Sedimentation fence shall be placed at the location shown as the work limit line. A septic system has been designed and
shall serve as it’s own mitigation, in its replacement of an older, obsolete septic system. All work is to be done by

machine (backhoe) and hand (planting on slope). The Pine trees as marked (along with 1 Oak tree), shall be removed
for: reasons of safety, being invasive, 2 trees in way of construction, or proper stewardship in the “thinning” of tree
groves where the individual trees are too close to each other. 3 Pitch Pines have already fallen down based on age,
disease (turpentine beetle), poor soil anchoring. The stronger tree (or trees) shall remain. Mitigation planting on the
property shall be placed, maintained, and monitored for a successful transition to new development. All planting is near
and on the coastal bank to beef up this area which is currently covered in Pennsylvania Sedge, an herb….all new planting
shall add to the woody shrub layer.
SUMMARY
This type of remediation project is an aggressive, but appropriate action to allow the owner to replace their home by
re-develpment. The TOCB, 35’ and 50’ buffer shall function in perpetuity without severe erosion or undercutting
AND allowing wildlife habitat to flourish. The steps taken simply isolate all human activity to a concentrated area
without effect on the buffer zone. The rest of the project is to be accomplished with an eye to continued conservation
stewardship that the applicants wish to foster if given the opportunity. Every sort of “fail-safe” method of
implementation and the end results shall enhance this Inland resource area. This concept requires an effort on behalf
of the Yarmouth Conservation Commission to realize that the applicant’s goals are conservation’s goals and this is
an absolutely, environmentally-sound, and defendable project.
