At their April 7, 2022 meeting,the Conservation Commission opened the Notice of Intent
hearing for the raising of an existing single-family dwelling and replacement with a flood
zone compliant foundation within the buffer zone to a bordering vegetated wetland and
within land subject to coastal storm flowage. At the hearing the Commission determined
that an area of patio had been installed within the buffer zone and setback to wetlands
without prior approval from the Conservation Commission. They requested that this
patio area be removed, and any proposed patio be shown on the plan outside the 35-foot
setback to the wetland. They also found that the footprint of the structure was being
expanded to accommodate a retaining wall and entrance walkway and that this expansion
is partially within the 35-foot setback to the wetland. They requested that the expansion
of footprint be reduced to be outside the setback, or that native buffer plantings be added
to the proposed plan at a ratio of 2:1 to mitigate for the expansion of footprint. The
Commission requested that the 35-foot setback line be shown on the plan and that gutters
and downspouts connected to drywells also be shown on the plan. The Commission
voted to continue the hearing to April 21, 2022, to allow for submission of a revised plan.
