Dear Honorable Members of the Town of Yarmouth Zoning Board of Appeals: On behalf of Volta, we are pleased to submit this letter to the Town of Yarmouth Zoning Board of Appeals (the “Board”) in support of the application by Volta for Variances for the installation, operation, and maintenance of two electric vehicle charging stations with digital advertising signs, or, in the alternative, to the extent necessary, all rights reserved, any other relief, for the installation, operation and maintenance of the charging stations with display signs on the Site. The following provides background information regarding the charging stations and addresses the applicable sections of the Zoning Bylaw. BACKGROUND Volta was founded in 2010 out of a passion for advancing electric transportation and since then, Volta has mastered the art and science of developing cutting-edge electric vehicle charging networks. Thoughtfully located along the paths of daily life, Volta chargers are the most heavily used in the charging industry. With the support of forward-thinking brand partners, Volta delivers free charging solutions to real estate owners, power to the electric vehicle community, efficient use of customers’ time and impactful brand stories to everyone. www.voltacharging.com The Volta charging station experience is a unique concept because Volta does not charge fees or costs to customers for the electricity but gives it away to encourage the use of electric vehicles. As the electricity ultimately must be purchased, Volta sells advertising space to brand name advertisers on the screens on its charging stations to generate the revenue needed to pay for the electricity. Notable advertising partners include Netflix, Jaguar, Alaska Airlines and Haagen Dazs. The advertisements shown on the screens are an integral part of the charging station and the electricity would not be available at no cost to the public without them. Volta currently has nearly 2,000 charging stations installed throughout the United States including many in Massachusetts in the following communities: Barnstable, Burlington, Marlborough, Northborough, Framingham, Natick, Boston, Wakefield and Belmont, to name a few. Charging stations are typically situated near retailers such as grocery stores. For example, charging stations were recently installed in front of a Star Market grocery store in Belmont, Massachusetts and the feedback has been terrific: “I'm sure that you will be delighted to hear that the customer reception has been incredible! Yesterday as a user at one station pulled out, another customer pulled right in! This morning I was paged to the service desk to receive more accolades from a customer about how “Great Star Market Is” to be on the forefront with these stations. ” Steve Duran, Store Director, Belmont Star Market 7 just want to thank you for bringing free Electrical Vehicle charging stations to my local Star Market in Belmont, MA. It is very convenient for me and helps to get the word out that electric vehicles are practical as well as environmentally desirable. The charging units are conveniently placed within the parking lot and have been well maintained. I hope the program expands and would especially like to see units where I typically spend more time. ” S. Harris, Electric Vehicle Owner, Belmont, MA Volta is also proud of its commitment to assist local communities with displaying emergency messaging on its charging station screens. The Volta Response System allows participating municipalities to show public service announcements and emergency messaging at no cost. This community service allows municipalities to reach communities such as the elderly, without expending local government resources on signs, ad space or media outlets. The clean energy impact from the Volta charging stations is immense: Town of Yarmouth Zoning Board of Appeals June 6, 2022 Page 3 • Powering over 73,000,000 free electric miles. • To date, Volta has offset over 32,000,000 pounds of CO2. • Total equivalent of over 369,000 trees planted. • Volta charging stations are the most used in the charging industry. THE SITE Volta proposes to install two electric vehicle charging stations with display screens in the parking lot of the Stop & Shop shopping plaza in front of the Stop & Shop at 484 Station Avenue, which because of digital advertising displays are capable of providing free electricity to the public to charge electric vehicles. The sleek and attractive stations consist of two Gen 4 Level 2 charging stations, both with charger and a two-sided digital advertising display screen. The charging stations will measure 36.5” in width, by 85” in height, by 15.5” in depth. On each face of the charging unit, there is a screen for advertisements, measuring 55” diagonally (48” in height by 27” in width). The ads are stationary and change approximately every eight seconds. There is no sound or noise emitted from the stations. The screens are backlit, similar to a TV screen and target pedestrians, not drivers. Although the display screens are intended for pedestrian traffic, out of an abundance of caution Volta follows an eight-second minimum advertisement loop which is the length of time recommended by the Federal Highway Administration. The two (2) proposed charging stations with display screens will not have an adverse impact upon the aesthetics of the area. The charging stations will be located within the parking lot of the plaza near the Stop & Shop and will be set back approximately 260’ from the nearest public road. The advertisements on the display screens are not intended for those traveling along the public ways but for those visitors and shoppers at the Stop & Shop. This is a beneficial, accessory and “green” use. Volta targets areas where customers are shopping so they can efficiently use their time in the store to recharge their electric vehicles, at no cost to boot. Only two existing parking spaces will be converted into parking spaces for electric vehicles at the charging stations. Those parking spaces are not eliminated, just designated for electric vehicle charging use. Given the distance to the nearest roads, vehicular traffic and parked cars as well as other existing obstructions on the Site, the proposed electric charging stations with display screens will have no visual impact on the neighborhood and surrounding roads while providing cutting edge “green” benefits to the public. Town of Yarmouth Zoning Board of Appeals June 6, 2022 Page 4 RELIEF REQUESTED Volta respectfully requests Variances from Section 303.3.1 (electronic message center), Section 303.3.4 (appearance of motion), Section 303.3.6 (off-premises signs), and Section 303.5.4 (freestanding signs) of the Bylaw pursuant to Section 102.2.2 of the Bylaw, Massachusetts General Laws chapter 40A, and such other relief as deemed necessary, all rights reserved, for the installation, operation, and maintenance of two electric vehicle charging stations with display signs on the Site. As will be further demonstrated by Volta by evidence submitted to the Board at the public hearing(s) in connection herewith, such relief is appropriate as the charging stations satisfy all pertinent provisions and standards contained in the Bylaw and Massachusetts General Laws for the granting of variances as enumerated below. VARIANCES 303.3.1 Prohibited Signs. Pennants, balloons, aerially supported devices, electronic message centers (unless specifically stated otherwise), quills/feathers, or any other sign not specifically allowed, are prohibited in all districts. Section 303.2 of the Bylaw defines electronic message center as “a portion of a sign that uses changeable lights to display words, symbols, figures or images that can be altered or rearranged by remote or automatic means.” To the extent the images are deemed an electronic message center, Volta requests an approval of the same per the requested variance herein. 303.3.4 Movement or Moving Parts. No sign shall move, contain any moving parts, or give the appearance of motion due to flashing or intermittent light, except portions of a sign which include electronic message centers per Section 303.3.2 and as limited thereby. No physical part of the charging stations moves, and the images displayed on the display screens change every eight seconds. To the extent the images are deemed moving, however, Volta requests an approval of same per the requested variance herein. 303.3.6 Off-Premises Signs. Except as indicated in Sections 303.4.1 and 303.4.2 below, no off-premises signs will be allowed. The electricity offered at no charge to the public is paid for by selling advertising space on the signs built into each charging station. If the off-premises signs are not allowed to function, then Volta cannot offer the free electricity to the public and the clean energy benefits of Volta’s electric charging stations will not be realized. Town of Yarmouth Zoning Board of Appeals June 6, 2022 Page 5 303.5.4 Free Standing Signs. 303.5.4.1 Singly Occupied or Co-branded Business Location. One free standing sign per business property having a maximum face area of twenty four (24) square feet with a maximum face height or width of eight (8) feet will be allowed. In the case of double faced signs only one sign will be counted for measurement. All advertising or lettering shall be contained within the face of the sign. No advertising, lettering, or internal illumination shall be allowed on the posts, pillars, arms, or other supporting structure with the exception of street numbers. No part of the sign shall be more than twelve (12) feet in height above the average natural grade at the street. All parts of this type of freestanding sign shall have a minimum 6’ setback from any property line. Section 303.2 of the Bylaw defines freestanding sign as “a sign not attached to a building which is supported from the ground by a post or other means.” To the extent that the charging station signs are deemed freestanding, Volta requests variances as to their number and size. 303.5.4.2 Business Centers. A business center may have only one (1) free standing sign, not exceeding twenty four (24) square feet in area, with the advertising area divided among the business enterprises or identifying the business center name or both, with a maximum face height or width of eight (8) feet will be allowed. No part of the sign shall be more than twelve (12) feet in height above the average natural grade at the street. All parts of this type of freestanding sign shall have a minimum 6’ setback from any property line. For Business Centers housing three or more tenants and a minimum of 20,000 square feet of retail/office space, the center may have a 48 square foot sign with a minimum setback of 12 feet. If a Business Center eligible for the 48 feet free standing sign has more than 1000 feet of frontage it may choose to divide the sign into two separate 32 square foot signs provided they meet 50 foot sideline setbacks and are separated by a minimum of 300 feet. Section 303.2 of the Bylaw defines freestanding sign as “a sign not attached to a building which is supported from the ground by a post or other means.” To the extent that the charging station signs are deemed freestanding, Volta requests variances as to their number and size. 303.5.4.3 Business Centers - Conformity. In each business center all freestanding signs will conform to each other as far as, material of construction, color, background and general style. All free standing business center signs must have one light, neutral colored background for the entire business center sign. Neutral colors shall be white, off-white, light grey or light tan. Each Town of Yarmouth Zoning Board of Appeals June 6, 2022 Page 6 tenant sign must have the same light, neutral colored background as the business center sign, and may have up to three (3) foreground colors. Black will be considered a color when determining the number of foreground colors allowed. White will be considered a color for background, but not a color for foreground. For example, a single tenant sign with light blue, dark blue, white and black foreground colors will be considered to have three foreground colors for the purpose of meeting the color requirement. Section 303.2 of the Bylaw defines freestanding sign as “a sign not attached to a building which is supported from the ground by a post or other means.” To the extent that the charging station signs are deemed freestanding, Volta requests variances as to their number and size. 102.2 Powers. The Board of Appeals shall have and exercise all the powers granted to it by G.L. ch. 40A, 40B and 41, as amended, and by this bylaw. The Board's powers are as follows: 102.2.2 To hear and decide appeals or petitions for variances from the terms of this bylaw, including variances for use, with respect to particular land or structures. Such variance shall be granted only in cases where the Board of Appeals finds all of the following: 1. Literal enforcement of the provisions of this bylaw would involve a substantial hardship, financial or otherwise, to the petitioner or appellant. 2. The hardship is owing to circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures, but not affecting generally the zoning district in which it is located. 3. Desirable relief may be granted without either: substantial detriment to the public good; or nullifying or substantially derogating from the intent or purpose of this bylaw. 1. A literal enforcement of the provision of this By-law would involve a substantial hardship, financial or otherwise, to the petitioner or appellant. Volta’s hardship is a financial hardship. If the charging station ad display screens are not permitted to be on the parcel, Volta cannot offer free electricity to the public or generate the revenue necessary to pay for the electricity. The electricity offered at no charge to the public is paid for by selling advertising space on the signs built into each charging station. If the signs are not allowed to function, then Volta cannot offer the free electricity to the public and the clean energy benefits of Volta’s electric charging stations will not be realized. The hardship is owing to circumstances relating to the soil conditions, shape or topography of such land or structures and especially affecting such land or structures but not affecting generally the zoning district in which it is located. The hardship is owing to the shape and topography of the land and its use as a shopping plaza renders the proposed location uniquely suited for the electric charging stations as there is ample room and the existing parking lot is an appropriate location for new technology designed to charge electric cars. The signage will be consistent with the existing commercial signage within the existing shopping plaza. The size of the parcel, along with the existing buildings upon it, will screen the electric charging stations and their built-in signs from view from nearby roads, thereby preserving the aesthetic qualities of the Town of Yarmouth. 3. Desirable relief may be granted without either: substantial detriment to the public good; or nullifying or substantially derogating from the intent or purpose of this bylaw. The proposed signs will not be a substantial detriment to the public good or nullify or substantially derogate from the intent or purpose of the Bylaw because the charging stations are located within the parking area of an existing shopping plaza, set back a distance from any street so that they will not have any visual impact on any Town streets or public rights of way. Further, the signs will be located in the Bl Business zoning district where illuminated signage is expected and commonplace. Though the signs will be of a modern design and will not be of wood or other traditional materials, the materials of the signage will be consistent with the existing commercial signage within the existing shopping plaza. The charging stations provide a public benefit in the form of free electricity, which promotes the use of green energy. CONCLUSION As evidenced by the materials submitted with this Application and as will be further demonstrated by the Applicant through evidence submitted to the Board at the public hearing(s) in connection herewith, the proposed electric vehicle charging stations satisfy the intent and objectives of the Zoning Bylaw in light of the size of the parcel, the commercial nature of the shopping plaza, as well as the charging stations placement within the Site (out of sight from nearby public roads) and the provision of free electricity for electric vehicles. The electric vehicle charging stations and related signage will not have any adverse impact to the surrounding neighborhood and the Town of Yarmouth as a whole as the advertisements are targeted to the shoppers parking in the parking lot and will have no visual impact on the public ways or Town of Yarmouth Zoning Board of Appeals June 6, 2022 Page 8 neighboring properties.
