I have been in business since 1986 with the majority of my work in the Town of Yarmouth. Kieran Healy from the BSC Group has asked me to layout the sequence of events at #62 Silver Leaf Lane with regards to building permits that I obtained from the Town of Yarmouth. In 2000, 1 was approached by the owner Mr. Harry Ward to review the finished basement area. At that time there was an existing kitchen, living room, and two sleeping rooms in the basement. In my mind the sleeping rooms would not be considered bedrooms, as the rooms did not have a second means of egress. I asked the Building Inspector at the time to meet me at the site and it was agreed that putting a "Scapewell" or window well on each room would allow these to be legal bedrooms. The living area has an interior stairway to a garage hall and an enclosed stairway as direct access at the back of the dwelling. Prior to Mr. Ward purchasing the property a permit was issued to construct a 5-bedroom septic system on site (permit #00-195,) which was approved and signed off by the Health Department. On November 15, 2000, 1 was issued a building permit #B-01$354 to add the two window wells and make the two rooms in the basement into compliant bedrooms. The permit issued at that time indicates "Existing Kitchen Downstairs". A later sign off on my permit by Mr. Bruce Murphy, Yarmouth Board of Health Director, indicates "Downstairs will add two bedrooms — has existing kitchen downstairs (2"d Kitchen in house) House will have 5 bedrooms total." Over the last 22 years I have been involved in the maintenance of the building and the basement has been used as a separate dwelling unit over that time. Yours Sincerely, David Hanbury 44-1
