Dear Sir or Ma'am:
This office is in receipt of the Title V variance requests that have been submitted to the Board of
Health for the property at 6 Smiths Point Road, West Yarmouth.
Variance(s) requested under 310 CMR 15.211: Minimum Setback Distances:
• The potable water well at 6 Smiths Point Road is 146' away from the SAS for 53 Uncle
Roberts Road,requesting a variance of 4' from the 150' requirement.
• The potable water well at 6 Smiths Point Road is 132' away from the SAS located at Lot
107 Smiths Point Road,requesting a variance of 18' from the 150' requirement.
Finding that the potable water well is located up gradient of both these soil absorption systems,
with groundwater flowing away from the well and toward these soil absorption systems,
maximum feasible compliance is obtained without compromising the quality of the potable water
well,therefore these variances have been approved.The well shall continue to meet drinking
water standards.

Notice is hereby given of a request for variances from MA Title 5 310 CMR 15.000 Regulations and/or
the Town of Yarmouth Regulations for Subsurface Disposal of Sewage. The following variances are
requested:

Variances:
1) To allow a variance of 18 ft. from the 150 ft. required setback between a potable well and
a soil absorption system located on an appurtenant septic system Lot 107; 132 ft. provided
2) To allow a variance of 4 ft. from the 150 ft. requirement between the potable well and a soil
absorption system location on an adjacent property at 53 Uncle Roberts Road; 146 ft. provided
The application and plan are available for review at the Yarmouth Health Department, 1146 Route 28,
South Yarmouth, Monday through Friday from 8:30 a.m. to 4:30 p.m. (excluding holidays).
Hearing on the above will be held Monday April 6, 2020 at 5:00 p.m., at Yarmouth Town Hall. Please
check with the Yarmouth Health Department (508-398-2231, ext. 1240) to confirm date and time of
hearing.
