The Applicant seeks a ruling by the Board of Appeals that the present uses of the Hall are
consistent with those uses allowed under Massachusetts General Laws Chapter 40A,§3 and both
the federal and state constitutions, citing Our Lady of LaSalette, Inc. v. Board of Assessor's-
Attleboro, 12-021 (2017) and The Bible Speaks v. Board of Appeals-Lenox, 8 Mass. App. Ct. 19
(1979).
In the alternative, the Applicant seeks a modification of the existing Special Permit to
allow for the Hall to rent out the facility on a limited basis in order to support the on-going
mission of the Church and to delete any references to "non-commercial" in the existing Special
Permit, #3788.
