WAIVER OF 45 -DAY DETERMINATION
The applicant/applicant's agent understands and agrees that due to the current declared National
and State public health emergencies the determination of our Application for a Certificate of
Appropriateness/Demolition/Exemption may not be made within 45 days of the filing of such
application.
The applicant agrees to extend the time frame within which a determination is to be made as
required by the Old King's Highway Regional Historic District Act.
SECTION 9 -Meetings, Hearings, Time far Making Determinations
"As soon as convenient after such public hearing; but in any event within forty-five (45) days
after the filing of application, or within such further time as the applicant shall allow in writing,
the Committee shall make a determination on the application. "

To the Old King's Highway District Committee:
Re: Exemption requested (drainage/retaining wall)
The Homeowner is requesting an exemption to have a small retaining/drainage wall built in the front lower
section of the property across from the existing wall which it will match the materials and construction. You
will see a wonderfully green lawn which I am using to mock up the project/problem. The green grass slope
turned into compacted dirt and then moss faces the driveway and the living fence at the lot line across the
drive as #8. It is also not seen by #I 1 because of the immediate plantings as well as those that will be
planted in front of the wall in line with the wall on the other side of the granite steps.
The slope has now been striped of all moss, back filled with dirt and over -seeded. However, the slope
drainage has not begun. The retaining/drainage wall will raise the slope about 2'-3' which should allow
good drainage through the new wall and pseudo -French drain graveled ditch.
The drainage became a costly issue especially because we discovered slightly leaking irrigation pipes and at
least two (2) sprinkler heads which are being replaced. This was no doubt why the area turn to moss in the
corner and further up the slope.
If the project isn't reviewed and decided on until after the Summer of 2022 (if approved) the drainage
problem will continue even after the irrigation system is fixed. With the Winter precluding digging and
further over -seeding and finding workers to build the wall will mean it will not be fixed until after the thaw
of 2023. The cost to the homeowner will increase exponentially.
As you will see in the mock ups on the following pages:
1. The new wall will match the dimensions/materials/presentation of the existing wall on the other side of
the granite steps,
2. The new wall will not be seen by any abutter:
• The front of the wall will be planted with flowers (roses and greens added in the photo)
• The lot line is planted with a continuous living privacy fence so #20 and #19 will never see the
wall
• No abutter will ever see the retaining wall itself as there are mature plantings at the corner; the
wall will be hidden from autos, buses or truck driving up Trophy to Setucket and completely
invisible to those driving from Setucket to Trophy (see mock ups)
• A person in an automobile would have to come halfway up my driveway to be presented with
flowers in front of the wall and maybe green grass above.

Existing wall (blue arrow) is 3' left side; decreases to 2'at right side. and is
approximately 5.5' long; it is a PA dry stack colors are mostly grey, blue and
shades of red; the black stones are a product of the Town's water staining the walls
through the irrigation system. The proposed drainage/retaining wall will be at right
and will be the same measures and stone as the existing.

This hill flattens out so fully that there is never any real drainage. The front lawn faces Trophy
Lane but because of the evergreen plantings it is hard to see the entire first floor of the house never
mind inside the driveway. The lawn on the right side hoping for a drainage wall, faces the
driveway and the Hamilton's house at #8. The house is surrounded by a living fence of arborvitaes
at the lot line so the wall again cannot be seen at #8, 11, 19 or 20 Trophy Lane.
