HomeMy WebLinkAboutRodgers Letter 7 28 22Josephine White Rodgers 85 Clark Street New Haven, CT 06511 914-282-2024 July 28, 2022 Town of Yarmouth Conservation Commission 1146 Route 28 South Yarmouth, MA 02664 RE: SE83-2201, 15 North Cove Landing, South Yarmouth; Request to Amend an Order of Conditions- Applicant Douglas and Beth Annino To the Conservation Committee, On July 20, 2022 Robert Perry submitted a request to the Committee to Amend work activity related to the driveway restoration that is jointly owned by 15and 11 North Cove Landing. The surface of the driveway needs repair due to its age and deterioration from the previous filing for a Certificate of Compliance for the Bulkhead project. The driveway referred to in the above referenced requests for amendments to the Order of Conditions is a deeded Right of Way on the edge of both referenced properties. The boundary line bisects the Right of Way. 15 North Cove Landing has a granted easement of four feet of the land of 11 North Cove Landing and 11 North Cove Landing has an easement of four feet starting from North Cove Landing and a slightly more extended easement in front of the two doors of the garage. The Sketch Plan Showing Work Access Driveway Resurfacing prepared by Robert M. Perry, P.E. Cape Cod Engineering, Inc., is not correct in that the joint easements are not displayed. These easements are displayed in the property map prepared by Down Cape Engineering, entitled Plan of Land in Yarmouth by Down Cape Engineering, February 14, 1985 of I 1 North Cove Landing, 30 Home Avenue, and the boundaries abutting 15 North Cove Landing. A copy of this Plot Plan will be provided before or at the meeting on August 4, 2022. There is not question that the Right of Way needs to be restored from the damaged caused by the joint project to restore the sea wall. The requested authorization needs to be amended to include the authorization for both 15 North Cove Landing and 11 North Cove Landing with proper recognition of the existing easements that have been established for quite some time. Both Josephine W. Rodgers and Kenneth W. Rodgers will be present at the August 4, 2022 meeting with the appropriate documentation. Respectively submitted,, p Jose i White odgers Keane W.
