Good morning,
I am writing on behalf of the Old King's Highway Committee chair in reference to the violation
letter you received from him regarding the rebar on your property in response to a complaint
from a resident.
In reviewing your response to the violation letter, the chair has decided to rescind the
violation, and just asks that you limit the use of the snow plow rebar markers to just the
duration needed.

If you remember, a resident had complained about a rebar fence at 15 Pine
Street. You checked out the complaint, found it valid, so we sent a violation
letter.
The resident came into town hall and talked to Mark Grylls. After speaking with
Mark, he sent the below email, which Mark forwarded to me.
The resident said he installs the rebars during the winter to keep the plows from
digging up his yard. He kept the rebar up because the house across the street is
being renovated and they want to keep the construction vehicles off their
property. He maintains that the rebar is not a fence.
How would you like to proceed at this point?

We are writing in response to the June 28, 2022 "Violation Notice" from Mr. Gegenwarth, Chair of the
Yarmouth OKH Committee.
Since 2009, like hundreds of other property owners in Yarmouth and throughout the OKH Cape wide, we
placed markers to minimalize possible damage from snow plows. Over the past year they have
remained given extensive renovation across the street and our desire to prevent damage from the
coming and going of construction workers and materials on our relatively narrow road.
Under any acceptable and justifiable definition, the posts do not constitute a fence. Respectfully, as
there is no fence, there is no fence to remove nor seek approval for. We request the purported violation
be rescinded.

Re: 15 Pine Street, Yarmouth Port, MA— Rebar Fence
Dear Property Owner(s),
As you are aware, your property is located in the scenic and historic Old King's Highway Regional Historic
District.
The Yarmouth Old King's Highway District office has received inquiries regarding the rebar fence that was
recently installed at the front of your property.
Please note that these types of fences are not allowed in the OKH District. As such, you are hereby informed
that you are currently in violation of the OKH Act for the following reason(s):
1. Installation of a fence without approval from Yarmouth Old King's Highway Committee
for appropriateness and setting.
To clear this violation, the Yarmouth OKH Committee requests that the rebar fence be removed within
30 days of receipt of this notice.
Enclosed are the OKH District fence requirements. To seek approval for a fence, please complete the
appropriate application and return it to the Yarmouth OKH office for review. Applications can be found on
the OK14 Department page on the Town's website at: http://www.yarmouth.ma.us/375/Old-Kings-
Highway-Hi storic-District.
Please note that failure to comply with the OKH Regional Historic District Act is subject to fines and
penalties as allowed per Section 12 of the Act.
We appreciate the efforts you have put forth to beautify your home and property and it is our sincere hope
that you understand our position and act swiftly to remedy the above-mentioned concern.
