Dear Mr. Hoopes and Members of the Conservation Commission:
BSC Group, Inc. (BSC) is pleased to submit this Variance Request on behalf of Longfellow Design Build, c/o Chuck
Texiera (the Applicant), for the property located at 74 White Cedar Point Road, (the Site). The proposed project at the
site involves razing and replacing a single-family home and detached garage, entirely within the 100’ buffer zone to
top of coastal bank. Portions of the existing and proposed single-family home are located within the locally regulated
0’-35’ buffer zone to top of coastal bank as well as the 35’-50’ buffer zone to top of coastal bank.
Yarmouth Wetlands Protection Regulations Section 1.09 (4) (d) (1 through 3) states that…
“Nothwithstanding section 2 below, no new structures (with the exception of water dependent structures), will be
allowed within 50 feet of Coastal Banks”
“Minor structures such as sheds, decks, and small additions may be allowed close r than 50 feet to a resource area but
no closer than 35 feet.”
“With the exception of vista pruning as allowed below, a 35 foot undisturbed natural vegetative buffer shall be
maintained between all projects and resource areas”
As such, we are requesting a variance to these regulations. The existing home is located directly at the top of the
coastal bank (ie. 0’ from the top of coastal bank). The proposed house has been pushed back 2’ so that it will not be
located directly on the coastal bank. There are currently ±1,803 sf of impacts within the 0’-35’ buffer to top of
coastal bank, and we are proposing 2,106 sf of impacts (increase of ±303 sf). There is an increase in impacts despite
moving the entire house back 2’ because the proposed house will enclose the small courtyard on the southeast side
of the house and the deck will extend around this new area.
Construction access to the site will be gained from the street. A long arm excavator will be used to remove the
existing home. The excavator will be located as far from the top of bank as possible to pull the debris from the
existing house back away from the top of the coastal bank. Roll off containers will be located within the existing
driveway or street and all construction debris will be placed into the dumpsters to be taken off site. No disturbance
of the coastal bank Is anticipated, but if any disturbance to the bank does result from this work, it will be planted and
stabilized Immediately following construction. Additionally, a line of sediment and erosion controls will be Installed
at the limit of work to prevent any sediment migration towards the wetland resource areas.

The client is proposing to mitigate for the new impacts within the 0’-35’ buffer zone at a ratio of 1.5:1; total of ±455 sf
of mitigation plantings. The plantings will include 20 bearberry, 15 lowbush blueberry, and 20 sweet fern. These will
be planted in an area of existing lawn. Approximately ±385 sf of the mitigation plantings will be located on the face
of the coastal bank Itself to provide additional stability. The entire ±455 sf of mitigation plantings will be located
within the 0'-35' buffer to wetlands/salt marsh.
