The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners’ packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) 1 original application with original signatures (double sided). A comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other supporting information. 1 original and 7 copies of the plan, folded separately, right side out with title visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. A 100’ radius map, current abutters list and abutters notification identifying the property owners who are to be notified per 310 CMR 10.00. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. A pdf copy of signed application, supporting information, and plan emailed to kgrant@yarmouth.ma.us. Please list project property’s street address in the pdf file name. Submit Certified Mail Receipts (PS Form 3800) for all abutters. Submit Certified Mail Receipts for Massachusetts Natural Heritage and Endangered Species Program and Massachusetts Division of Marine Fisheries. Notice of Intent 74 White Cedar Road Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project located at 74 White Cedar Road (the Site) in Yarmouth, MA involves razing and replacing a single-family home. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 74 White Cedar Road contains a single-family home. The property is bordered by single family homes to the north and northeast, with a wooded lot to the south, and Lewis Bay to the east. The wetland resource areas and areas of conservation jurisdiction on the site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include: • Coastal Bank • Land Subject to Coastal Storm Flowage, Zone AE (Elevation 11) • Salt Marsh 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: Raze and Replacement of Single-Family Home: The proposed project is to raze and replace the existing single-family home and detached garage. The existing home is not flood zone compliant, but the proposed home will be flood zone compliant. All existing structures are located within the 100’ buffer to top of coastal bank and a portion of the existing and proposed home are located within the 0’-35’ buffer to top of coastal bank. As such, we are requesting a variance (see attached variance request) to rebuild the home within the 0’-35’ buffer to top of coastal bank. The existing house is located directly at the top of the coastal bank (ie. 0’ from top of coastal bank). The proposed house has been shifted backwards 2’ from the top of coastal bank so that the new home will not be located on the coastal bank. Construction access to the site will come from the street. A long arm excavator will be used to remove the existing home. The excavator will stay away from the top of the coastal bank and will pull the debris from the existing home back away from the bank. Roll off containers will be located on the street side of the house within the existing driveway or street and all debris will be placed Into the dumpsters to be hauled off site. Any disturbance that does occur to the bank will be stabilized and planted immediately following construction. No grading on the coastal bank will be necessary. The proposed house is slightly larger than the existing home by ±569 sf. The proposed house has been shifted 2’ back from the coastal bank, but there will be slightly more impacts within the 0’-35’ buffer to top of coastal bank because the proposed house will not have the small semi-enclosed courtyard on the southeast side of the house. Instead, this area will be closed off inside of the new home . Additionally, the proposed deck will be extended around this side of the house. This will create ±303 sf of new impacts within the 0’-35’ buffer to top of coastal bank. Mitigation is proposed for this increase in disturbance to the 0’-35’ buffer zone to top of coastal bank. Mitigation is proposed at a ratio of 1.5:1, so an area of ±455 sf. Table 1 details the mitigation plantings, and the plants will be located in an area of existing lawn. All the mitigation plantings will be located within the 0'-35' buffer to wetlands/ salt marsh and ±385 sf of the mitigation plantings will be located on the face of the coastal bank. The detached garage will be rebuilt with a second story office. The proposed garage will be constructed within the same footprint as the existing building except for the addition of outdoor stairs to lead up to the second story office 4.0 MITIGATION MEASURES A line of erosion controls will be installed at the limit of work to prevent any sediment migration towards wetland resource areas. A long arm excavator will be used to remove the existing building. The excavator will be situated as far from the top of the coastal bank as possible while pulling the construction debris back away from the top of the bank. Roll-off containers will be located within the existing driveway as far from the resource areas as possible. Any debris which falls within resource areas will be removed by hand as soon as possible. Caution will be taken to ensure construction byproducts do not enter the resource areas. Mitigation plantings are proposed for the new impacts within the 0’-35’ buffer to top of coastal bank. No disturbance to the coastal bank Is anticipated, but If any disturbance does result from the work, the bank will be planted and stabilized Immediately following construction.
