The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioners’ packets within the week before a meeting. Failure to follow this Checklist shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) 1 original application with original signatures (double sided). A comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets or other supporting information. 1 original and 7 copies of the plan, folded separately, right side out with title visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to show proposed & existing conditions, native species, size and spacing. A 100’ radius map, current abutters list and abutters notification identifying the property owners who are to be notified per 310 CMR 10.00. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. A pdf copy of signed application, supporting information, and plan emailed to kgrant@yarmouth.ma.us. Please list project property’s street address in the pdf file name. Submit Certified Mail Receipts (PS Form 3800) for all abutters. Submit Certified Mail Receipts for Massachusetts Natural Heritage and Endangered Species Program and Massachusetts Division of Marine Fisheries. The property contains a waterfront restaurant and parking lot. The majority of the subject property along Parkers River is armored by a licensed rock revetment and concrete mortar which is in disrepair. The northern section of the revetment was permitted to be reconstructed in May 2011 and construction occurred shortly after. The revetment was built to more current design standards which included no concrete mortar between the rocks. This was done to repair that section of the revetment due to the failure that had occurred. The gap between the northern section and the section south of the gap to the north side of the restaurant continued to deteriorate as the salt marsh along the shore in the gap started to erode. The marsh and revetment have been undermined and slumping is now a continual occurrence at the site. With concrete fill creating a solid structure, the slumping has led to the structure falling more as one solid structure and not just a displacement or shifting of individual stones as well as cracks forming in the concrete between the stones. The cracks in the concrete along with the lack of filter fabric behind the wall allow for subgrade to get washed out, causing further slumping and failure. A sink hole has formed behind the existing revetment. If further erosion occurs, the existing restaurant foundation could become compromised. Project Description The purpose of the project was to provide an emergency repair to temporarily stabilize the shorefront area. Chink stone was placed in the gaps of the revetment to stabilize the area and prevent further destructive erosion. No concrete was poured within the voids to allow for some rock movement without having one large structure failure. There was no expansion of the existing structure footprint seaward or to the north. The emergency repair is an interim phase of the full project and is intended to provide temporary protection to the building while the full project is designed and permitted. The applicant intends to file a Notice of Intent to complete the shoreline protection project within the next year. This full project scope is currently in design discussions with MassDEP Waterways as there is an existing license. Since the project would require review from multiple agencies such as the MassDEP Waterways Program and the US Army Corp of Engineers, the timeline to acquire all the necessary permits would be approximately one year or more and there was an urgent need to provide repairs now before further failures occur and jeopardizes the integrity of the foundation. Overall, the project had no impact to the coastal wetland resource areas because it was all within the existing footprint . Wetland Resource Areas and Performance Standards The existing property is located along Parkers River. The project area is within the FEMA Flood Zones AE (EL 13) and AE (EL 12) as show on the Firm Panel C25001C0588J. The project area is directly within or within the 100’ buffer to coastal resource areas that include Riverfront Area, Coastal Bank, Land Under the Ocean (LUO), Land Subject to Coastal Storm Flowage (LSCSF), and Salt Marsh. The resource areas are covered under the 310 CMR 10.00: Wetlands Protection Act Regulations as well as the Town of Yarmouth Wetland Protection Regulations. We have addressed the potential impacts to these Resource Areas based on the Performance Standards under both the State and Local Wetland Protection Regulations in the following sections. C17564.01: Notice of Intent Application Gold Village Waterside LLC, 681 Main Street, Yarmouth Page 3 of 7 State Wetlands Protection Act 310 CMR 10.00 10.04: Land Subject to Coastal Storm Flowage "land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater" The Land Subject to Coastal Storm Flowage (LSCSF) does not have regulation performance standards, though it is a protected resource area and therefore approval is needed to perform work within the LSCSF. The project will not adversely affect LSCSF as it took place within the footprint of the existing revetment. 10.25: Land Under Ocean “land extending from the mean low water line seaward to the boundary of the municipality's jurisdiction and includes land under estuaries.” No improvement dredging or maintenance dredging occurred. The project will help prevent further erosion of the Coastal Bank by slowing the erosive forces from the current. The chink stone was placed in the footprint of the existing revetment, and it is anticipated that the placement of the stone will have negligible effects on water circulation. There was no evidence of eel grass beds in the work area. There was no proposed fill that would alter the distribution of sediment grain size. There were no alterations in water quality from the stone placed in the revetment voids. There was no evidence of high densities of polychaetas, mollusks or macrophytic algae in the project area. The project is not within the habitats identified by Natural Heritage Endangered Species Program (NHESP). 10.30: Coastal Banks "the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action, or other wetland." The project was a temporary repair. The emergency repair was necessary to protect the failure of the building foundation and to prevent debris from the parking lot entering the water column. Protective plantings were not a part of the emergency repair. There will be no adverse effect on wave action or the movement of sediment from the placement of chink stone in the gaps of the existing revetment. The chink stone will increase the stability of the Coastal Bank by reducing the amount of sediment directly impacted by water. The project is not within the habitats identified by Natural Heritage Endangered Species Program (NHESP). 10.32: Salt Marsh " a coastal wetland that extends landward up to the highest high tide line, that is, the highest spring tide of the year, and is characterized by plants that are well adapted to or prefer living in, saline soils. Dominant plants within salt marshes typically include salt meadow cord grass (Spartina patens) and/or salt marsh cord grass (Spartina alterniflora), but may also include, without limitation, spike grass (Distichlis spicata), high-tide bush (Iva frutescens), black grass (Juncus gerardii), and common reedgrass (Phragmites). A salt marsh may contain tidal creeks, ditches and pools." Salt Marsh is mentioned because the gap between the two existing revetments used to be comprised of salt marsh, however the accelerated erosion has caused the majority of the peat to disappear, and no salt marsh grasses remain. The riverfront area may include or overlap other resource areas or their buffer zones. The riverfront area does not have a buffer zone." The chink stone placed in the voids, within the existing footprint of the previously permitted revetment, did not affect the other resource areas listed above, was not within the habitats identified by Natural Heritage Endangered Species Program (NHESP) and was the most practical and economic solution for an emergency repair. The Town of Yarmouth Wetlands Protection Regulations 2.01: Land Under the Ocean No improvement dredging or maintenance dredging occurred. The project will help prevent further erosion of the Coastal Bank by slowing the erosive forces from the current. The emergency repair was necessary to protect the failure of the building foundation and to support the parking lot reducing parking lot structures from failing and becoming debris in the water column. Protective plantings were not a part of the emergency repair. There will be no adverse effect from filling the gaps in the revetment with chink stone on wave action or the littoral movement of sediment. 2.06: Salt Marshes Salt Marsh is included as a resource because at the time the revetment was licensed there was salt marsh in the gap between the sections of revetment. However, the accelerated erosion has caused the majority of the peat to disappear, and no salt marsh grasses currently exist. 2.10: Land Subject to Coastal Storm Flowage No septic repairs occurred during the emergency repairs to the revetment. Groundwater elevations are not measured for this type of project. This project did not include construction of a deck, shed or other structure. Other Protected Resource Areas Other resource areas protected under regulations include FEMA flood zones, Natural Heritage Endangered Species Program (NHESP) priority and estimated habitats of rare wildlife species, Area of Critical Environmental Concern (ACEC), and Impaired Waters. The project site is not located within an ACEC, any priority or estimated habitat of rare wildlife species. C17564.01: Notice of Intent Application Gold Village Waterside LLC, 681 Main Street, Yarmouth Page 5 of 7 FEMA FEMA Firmette for the Project Locus The project area is within the FEMA Flood Zones AE (EL 13) and AE (EL 12) as show on the Firm Panel C25001C0588J. These elevations are based on the North American Vertical Datum of 1988 (NAVD88). Impaired Waters Parkers River (MA96-38) is designated by MassDEP as an impaired waterbody with an established Total Maximum Daily Load (TMDL) for Fecal Coliform. Fecal Coliform is an impairment usually caused by pet waste, sewer/septic discharges, boat pumpout releases, and waterfowl waste. This project will have no adverse effects on any of the sources of impairments listed above. Alternatives Analysis The following paragraphs describe the alternatives that were reviewed in the feasibility and design phases of the project development. The alternatives were reviewed based on reaching the project goals while minimizing impacts to the resource areas, constructability, and remaining economically feasible. Alternative 1 – No Action If nothing were done, the revetment would continue to be undermined and lead to a larger failure of the revetment directly protecting the building foundation. A failure of the revetment would cause the parking lot C17564.01: Notice of Intent Application Gold Village Waterside LLC, 681 Main Street, Yarmouth Page 6 of 7 and building foundation to be exposed to the same destructive forces which could leach associated pollutants into the waterbody and damage the building. The scoured areas behind the existing revetment would continue to erode, adding siltation into the waterbody. As the land under the parking lot and foundation of the restaurant erode the structures would fail. Alternative 2 – Emergency Repair with Chink Stone (Selected Alternative) The voids in the existing revetment were filled with chink stone to prevent further erosion. This helped stabilize the bank and upland area. This was done intentionally as an emergency repair to prevent immediate loss of upland area. This was the more economically feasible emergency repair to the bank to prevent continued slumping of the larger stones. Alternative 3 – Reconstruct the Revetment (Preferred Alternative) In order to provide long-term stability to the adjacent structures, the revetment will require reconstruction as well as an extension into the gap between the two sections of revetment. Due to the currents in the river the scour at the toe of the revetment will continue. Additional engineering will be required to determine the depth of the toe of the revetment to adequately stabilize the shoreline. Under the current time constraints for submittal of the follow-up NOI submittal, full engineering has not been completed at this time and will occur prior to a full shoreline reconstruction NOI. A combination of toe bulkhead wall or additional depth of the revetment toe with revetment reconstruction and expansion across the gap is the preferred alternative for a long-term solution to the stability of the bank at the subject property. However, due to the long permitting process for a project of this scope, the Emergency Repair option was selected to prevent catastrophic damage to the property prior to a long-term solution being permitted and ready to construct. Once the final full design for the shoreline protection has been finalized, a Notice of Intent process can begin with the goal of long- term stabilization. Construction Protocol Prior to the Start of Construction: Prior to the start of any work there was an on-site meeting to review the emergency repairs and to satisfy the Conservation Agent that the work will be done as specified, this occurred Friday August 12, 2022. The construction started on Monday August 15th and was complete before noon on Tuesday August 16th, 2022, after completion of all pre-construction requirements outlined in the specifications and Emergency Certification Form, as well as any pre-construction requirements outlined during the pre-construction meeting. On-Site Meeting: Prior to start of construction a meeting occurred to discuss access and means of construction with the following individuals represented: Construction Contractor Coastal Engineering Co. Access & Staging: The access was from the parking lot on site. The staging area was in the parking lot, outside of any area that was threatened by the erosion. Equipment: During the course of construction, the following equipment was used: Excavator. Miscellaneous hand tools. Work Completion: Upon completion of the repair efforts, all disturbed surfaces were ready for re-vegetation to be performed as soon as seasonally reasonable. The Contractor notified the Engineer of meeting with the parties taking part in the pre-construction meeting, prior to removal of equipment. No deficiencies were identified to the Contractor by the Engineer. Vegetation Protocol: Upon completion of the construction effort, and as soon as weather permits to meet the first growing season, disturbed areas, are to be re-vegetated with previously existing species or similar as determined by the Conservation Agent. Post Construction Photographs: The Owner, or Engineer shall supply the Conservation Commission with post-construction photographs of the access and staging area, and the project locus, as well as the final emergency repair as attached to this narrative. Summary and Recommendations The purpose of the project was to provide stabilization to the shorefront area along the subject property and protect the upland from damage. The project included the emergency repair of filling in the voids of the revetment with chink stone to prevent erosion and slumping. This project stabilized the shorefront area that is currently experiencing erosion until a permanent solution can be designed , approved, and constructed. The project emergency repair had adverse effects on the wetlands resource areas and wildlife habitats as all the work occurred within the footprint of the existing revetment. Each performance standard under the State and Local regulations has been addressed. The information provided adequately describes the project and the design considerations taken to prevent adverse impacts to the wetland resource areas.
