As of this date, September 7, 2022, your application is deemed administratively complete. The Conservation Commission has sought peer review services to assist with review of the application. The Commission plans to engage consultant TRC Companies, INC, to provide this service. The scope of work and the associated costs are detailed in the attached proposal for your information. Please submit $ 2,600 in full to the Town of Yarmouth within ten (10) business days of this notice. The fee must be received prior to the initiation of consulting services. Funds received pursuant to M.G.L. Ch. 44 §53G shall be deposited with the Town of Yarmouth Treasurer, who shall establish a special account for this purpose. The Commission may request additional fees if review requires larger expenditure than originally anticipated or new information requires additional consultant services. The consultant has committed to having review comments available on or about September 28, 2022, if they are authorized to begin work by September 9th, 2022. To authorize the review, the peer review funds must be submitted to the Town. This timeline would allow for the application to be scheduled for the October 6, 2022, Conservation Commission meeting. Our proposal describes our proposed approach to completing the peer review, deliverables, and our proposed compensation for the services to be provided. Scope of Work Based on the application documents provided to TRC on September 2, 2022, the Conservation Commission’s objectives, and the requested scope of work described in the “Request for On-Call Services”, dated May 26, 2021, as well as on our experience with providing similar professional service, ESS proposes the following approach. TASK 1: INITIAL TECHNICAL STORMWATER PEER REVIEW TRC will provide a technical stormwater peer review of the Stormwater Management Permit Application prepared by Baxter Nye Engineering & Surveying submitted to the Commission on August 31, 2022 and provided to TRC on September 2, 2022. The review will include: • Review for technically complete application –incomplete/inaccurate information needed to review the application will be identified. • Determination as to whether the proposed plans/BMPs meet the Stormwater Management Regulations, effective July 1, 2021. • Identification of items to be modified for compliance. • Recommended permit conditions, if applicable. • A comment letter summarizing the findings of the review. The letter will be addressed to the Conservation Commission (via the Conservation Administrator), and copied to the Town Engineer. Deliverables: A single comment letter provided in PDF format. TASK 2: ADDITIONAL REVIEWS AND CONSULTATION SERVICES TRC will review additional submissions and responses to comments as requested. TRC will provide additional consultation services such as phone calls, meetings, public hearings, written correspondence, additional revisions, etc. as requested by the Conservation Commission. Ms. Brittany DiRienzo September 6, 2022 2 Schedule TRC is prepared to begin work on this scope of work immediately upon execution of a contract with the Town of Yarmouth. Assuming that written notice to proceed is provided to TRC by September 9, 2022, TRC anticipates completing the scope of services described herein on or about September 28, 2022. TRC will keep the Town apprised of significant findings throughout the project. TRC is not responsible for delays in performance caused by circumstances beyond our control, or which could not have reasonably been anticipated or prevented. Assumptions The proposed compensation described in this proposal is predicated on the Scope of Work described above and the following assumptions:  TRC will assume that all information provided to TRC by others is complete and accurate.  Conditions may be revealed during the Project that were unknown during preparation of this proposal. Such conditions may require additional services to be performed.  To reduce costs and impacts to the environment associated with paper deliverables, TRC deliverables will be provided in PDF format unless otherwise noted.  In the event that changes in policy or regulations of agencies having jurisdiction or changes in COVID-19 related restrictions occur after the date of this agreement, and such changes require additional office or field work, the additional work will be completed as an additional service on a time and materials basis. Compensation The following table presents TRC’s proposed compensation for its services for this project. TRC proposes to perform the Scope of Services on a time-and-materials basis. The total estimated cost to provide the services described in this proposal is $2,600. Should the Town request TRC to make changes in the services or to perform additional services, TRC will prepare a Change Order for the Town’s acceptance prior to execution of the work. Task Est. Labor Hours Cost Estimate Task 1: Initial Technical Stormwater Peer Review 12 $2,600 Task 2: Additional Reviews And Consultation Services As Requested -- Totals 12 $2,600 The time and materials cost for the services provided above is an estimate and actual incurred costs may vary from this estimate depending on a variety of factors. TRC will provide notification if we expect incurred costs will exceed 15% of the estimate. Time expended providing services, including travel time, will be charged, unless otherwise specified above. Associated subconsultant and other direct costs (travel expenses, copies, etc.) will be treated as reimbursable expenses and will be invoiced on a Time and Materials basis at the rates specified on the enclosed Rate Schedule. Any time or costs associated with compliance with COVID-19 related protocols or orders will be invoiced as an additional service on a Time and Materials basis. If this Agreement is satisfactory to the Town of Yarmouth, please sign in the required spaces on the Work Authorization and return a fully executed copy to my attention and retain a signed copy of the Work Authorization for your records. If the Town requires a Purchase Order for payment purposes, please submit the Purchase Order referencing and incorporating this Agreement, including TRC's Proposal and Proposal Number in addition to the signed Work Authorization.
