The Preliminary Plan as proposed was denied as it was deemed to not be consistent with the
intent and purpose of the Subdivision Control Law and would require the waiving of most if not
all of the required improvements outlined in the Town of Yarmouth Rules & Regulations
Governing the Subdivision of Land. The plan creates illusory frontage for the sole purpose of
meeting Zoning Bylaw Section 203.2.1 to allow for the creation of two lots. Relief from the
Zoning Bylaw requirements should be sought through the proper authority, which is the Zoning
Board of _Appeals, and not through the creation of a faux subdivision.
