The property involves an unbuildable lot which has been included as part of 30 Horse Way in Assessor Map 51, Parcel 22.1. The unbuildable parcel to be subdivided was shown as Parcel V in the original ANR Plan #1428 from 1960. The applicant proposes to divide Parcel V into Lot V-1 & Lot V-2. The intent is to have Lot V-1 remain with 30 Horse Way and sell Lot V-2 to 159 Old Main Street. The proposed division has gone through the Zoning Board of Appeals, as required when changing the lot-lines on non-conforming lots. The ANR Plan notes the ZBA Decision and the Barnstable Registry of Deed Book and Page number. The submission was complete and included the required fee, Form A, ANR plan, and appropriate number of copies. The ANR Plan is entitled, “Subdivision Plan, South Yarmouth MA Prepared for Suzanne Packer 30 Horse Way South Yarmouth MA” and was prepared All Cape Septic LLC, dated December 22, 2017 and stamped by Steven Moore, PLS on May 4, 2018. The Town Surveyor had several comments as outlined in the attached May 14, 2018 Memo. This information was relayed to the applicant’s representative, Attorney Matthew Fitzsimmons. Although Attorney Fitzsimmons noted that he would work to have the changes made to the plan prior to the Planning Board meeting, a revised ANR Plan had not been received prior to the compilation of this Memo. This application was received on May 9, 2018, but an extension was given until June 6, 2018. This project has been placed on the Planning Board Meeting Agenda for June 6, 2018. Planner Suggestion: Subject to the changes requested by the Town Surveyor, recommend the Planning Board make a motion to endorse ANR Plan #1428A, dated______________.
