Dear Mr.Murphy and Members of the Board: BSC Group,Inc. (BSC)is requesting that the existing Title 5 septic system be allowed to remain at#185 Seaview Avenue.The septic system designed by Ronald J.Cadillac, PLS, RS,PC and installed in 2014 and was approved with variances by the Health Department at that time. The current building is within a flood zone.One of the requirements of flood zone construction is if the building renovation costs more than 50% of the valuation of a house, the house needs to be flood zone compliant.With the new elevation being higher than existing and the current foundation not being FEMA complaint it makes more sense to replace the house altogether. In consideration of this application,I would ask the Board to consider the following. 1.) The existing dwelling is 3 bedrooms,and the proposed dwelling is 3 bedrooms. 2.) The septic system is a Title 5 system having been installed in 2014 and seasonally used over the last 8 years. 3.) None of the previous Health Department variances issued were regarding the building location. 4.) This new building location does not trigger any new Title 5 variances. 5.) This property is not located within a State Zone II—wellhead protection area. 6.) New water saving devices will be installed to reduce wastewater flow. 7.) As sewer is being proposed for this section of Yarmouth,the system would be connected once Sewer becomes available. 8.) A Health Department stamp on the plan indicates that any future additions/ renovations/alterations shall be reviewed by the Board of Health.BSC Group was Engineers under the impression this note meant that any changes would be reviewed by the Board of Health to confirm no additional bedrooms/no additional flow or no Environmental additional variances were being added and that this note was not a requirement that a Scientists new septic system would need to be installed. 9.) Title 5 is very specific in how they deal with"New Constructioe The language in. Custom Software Title 5, Section 15.002 is: Developers "New construction shall not include replacement or repair of a building in existence Landscape as of March 31, 1995,that has been totally or partially destroyed or demolished, Architects provided there is no increase in design flow."
