RE: Shoreside Properties LLC, Petition 4979
We heard from our neighbors about upcoming hearing regarding
awarding a 100% seasonal employee housing status to Shoreside
Properties located at 33-37 Seaside Village road in our South
Yarmouth neighborhood. We appeal to the Board of Appeals to
decline this request.
We second the reasons, expressed by our neighbors, e.g.
Critically important for us, hosting two of our 1- and 9-years
old grandsons, safety, which will be naturally endangered
by the presence in our backyard of many hardly traceable
non-residents.
Inevitable loss of value of our purchased for big bucks and
upgraded for being used, as a year-round retirement place,
let alone the property taxes, practically doubled over years,
we lived here.
I and my wife are first-generation US immigrants. We came to
this country 30 years ago and loved it here, to large extent
because this country is one of not many places in the world,
where laws are both reasonable, meticulously observed and
equally applied. All laws, Town of Yarmouth Zoning Bylaws
included.
Faced with this case, we reread the Bylaws. It's a thoroughly
balanced and with mathematical precision formulated document,
explaining the spirit, and providing guidance for resolving most
situations and conflicts of interests. We believe that both the
word and the spirit of Bylaws clearly oppose giving Shore side
Properties the status of a 100% seasonal employee housing.
We appreciate that local businesses need accommodations for
the seasonal help and p.404.5 clearly grants respective
provisions, yet applies reasonable boundaries, generously
limiting this kind of occupancy at 15%. Housing seasonal
employees in excess of this limit turns the hotel into a dorm, and
that is not the same thing. Having lived in the sanctuary
Cambridge, MA for many decades I witnessed, how
overpopulating certain, even prime areas with temporary
residents brought not only dirt in streets but also crime, personal
assaults, hooliganism, and burglaries to "my fair city". We don't
want to see it here in safe and quite South Yarmouth.
Besides, doesn't changing 15% long-term occupancy to 100%
change the status of this case from p.404.5 Seasonal Employee
Housing at Motels/Hotels to p.404.3 Extended Stay Hotels? We
believe, it does. But in that case why won't Shoreside Properties
don't apply for this amendment? It will be fair and will fully
comply with the Bylaws without any need for exceptions.
Maybe, because their facilities do not comply with strict but fair
requirements to the size, composition and equipment of units,
specified for the Extended Stay Hotels.
Summarizing our objections, we see that the whole purpose of
this request for amending the Bylaws to satisfy requests by the
owners of Shoreside Properties carries all signs of an attempt to
make quick and easy bucks at the expense of safety, comfort,
and property values of the taxpaying residents of this prime
residential neighborhood.
