Barry, Jr. Family Living Trust, and the owner of the property at 63 Parkwood Road, South Yarmouth, MA. 2. The Defendants, Lawrence Morreale and Angela M. Morreale, are the Trustees of the Lawrence Morreale Living Trust of 183 Hartford Street, Natick, MA 01760, and are the owners of property at 59 Parkwood Road, South Yarmouth, MA. (Hereinafter referred to as "Morreale" or the "Applicants"). 3. The Defendants, Steven DeYoung, of 691 Willow Street, South Yarmouth, MA 02664, Sean Igoe, of 223 South Sea Ave., West Yarmouth, MA 02673, Bryant Palmer, of 66 Traders Lane, West Yarmouth, MA 02673, Gerald Garnick, of 258 Winter Street, Hyannis, MA 02601, and Chuck Hart, of 2 Jerusha Lane, West Yainxouth, MA 02673, are the duly appointed members of the Yarmouth Zoning Board of Appeals. (Hereinafter collectively referred to as the "Board"). 4. In May of 2015, the Applicants filed an application with the Board, seeking relief from the Yarmouth Zoning Bylaw, in order to be permitted to construct an attached garage to their pre-existing non- conforming single-family home at 59 Parkwood Road, South Yarmouth, MA. 5. The Plaintiff's property is located adjacent to the Applicants' property, and he was notified, as a party in interest, of the application and pending hearing on the Defendants' application. 6. On June 11, 2015, the Board held a hearing on the Applicants' said application, and after hearing voted to grant the requested Special Permit to authorize the construction of the non-conforming addition to the applicant's home. 7. The Plaintiff opposed the said application at the Board's hearing, and is aggrieved by the Board's decision. 8. The Board filed the decision with the Yarmouth Town Clerk on June 17, 2015, an attested copy of which is attached hereto as Exhibit A. 9. Plaintiff believes, and therefore alleges, that the Board exceeded its authority by making the decision to grant the Defendants' application. Wherefore, the Plaintiff requests that this Honorable Court declare the Board's decision to have exceeded the lawful authority of the Board, declare said decision to be null and void, and to enter such other or further equitable relief as the Court may deem just and proper. Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property as required by law, and to the public by posting notice of the hearing and publishing in The Register,the hearing opened and held on the date stated above. The Petitioner is Lawrence Morreale, Trustee of LA Realty Trust which holds title to 59 Parkwood Road, South Yarmouth, MA property in an R-25 Zoning District. The Petitioner seeks a Special Permit pursuant to By-law §104.3.2 (2) in order to construct a 24' x 26' garage to the southeast side of his residence. If allowed, the completed structure would be from 17.9' to 12.4' from the abutter's side line. The Board received 2 Exhibits, a letter of support dated 6/9/15 from Mr. and Mrs. Sheehan at 54 Parkwood Road and a letter of support dated 6/1/15 from Mr. and Ms. Cloran of 60 Parkwood Road. The Board also heard from Ralph Barry of 63 Parkwood Road, the abutter most affected by the proposed relief. Mr. Barry spoke well of his feelings that the structure would be too close to his home which he had taken pains to locate so as to preserve his privacy. The relief sought was, at least, minimal and related to only approximately 50% of the length of the proposed garage. Even at its closest, it is only 2.6' from what would be allowed without relief. Moreover,the Board was mindful that, as this is a corner lot, location elsewhere on the property would be very difficult, requiring front set-back relief which the Board is historically reluctant to grant. Lastly,the Board consensus was that,as the addition is a garage, it would not impact the Barry family privacy. Finding that the Special Permit, if granted, would result in no undue hazard, nuisance nor congestion nor cause any substantial detriment to the present or future character of the neighborhood or Town,Mr. 1 / Palmer then moved to grant the petitioned relief and Mr. Hart seconded. Upon this Motion, the Board • / voted unanimously in favor and the Special Permit was therefore,granted without condition. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this notice/decision with the Town Clerk.
