New Map: 98 New Lot: 80 Location: 167 White's Path, South Yarmouth Old Map: Old Lot: Persons Present: Terry Sylvia Carl Lawson Barfly Jones Mathew Bearse Karen Greene Dan Ojala Tim Myland Vern Santos Bruce Muphy Proiect Summary The applicant proposes a new 3000 square foot addition to an existing metal building, presently used for the sale of plumbing supplies. The new addition would be used for the wholesale sale of plumbing fixtures and would be a showroom for those clients. The site is located in the B3 Business Zone and within the Aquifer Protection Overlay District (APD). Comments Building: While the Building Commissioner was not present, he did submit the comments below: 1. The use is identified in Table 202.5 as G1. The proposed addition and parking areas lie within the B3 zoning district. A small portion of the northerly side of the proposed addition lies within the R40 zoning district. The entire site lies within the APD. 2. The total proposed impervious lot converge is 72%. Table 203.5, Footnote P limits such coverage to a maximum of 70%. Therefore a variance is required from the Board of Appeals 3. I am unable to determine if all existing side and rear buffers are compliant and whether additional parking is being proposed. More definition is required. 4. A special permit as per Section 406 and Table 202.5 or in the alternative a "Determination of Non Applicability"outlined in Section 406.5.1.1 is required because the site is within the APD. 5. All construction shall comply with the applicable provisions of 780CMR (State Building Code), including Construction Control. Conservation: Not pr.,,unt. Design Review: Not present. { Community Development: Project will provide 3-4 additional jobs. Recommended speaking with Building \t Commissioner/Zoning Administrator regarding the discussion of the retail and wholesale use. Project will allow a local business to remain competitive and viable. Engineering: Area underneath proposed addition is currently pervious since no plans were filed for any"existing" site work there. The applicant proposes to remove pavement from SE corner of site and replace with gravel. Without more specific information provided, this area will be deemed to be impervious. , Fire: PIV valve needed, as well as engineered sprinkler plans for the proposed addition. LPG storage concerns addressed. Health: All Material Safety Data Sheets(MSDS) should be kept onsite and be available to all employees. Fire Dept. '— recommendations should be followed regarding the storage and labeling of flammables such as propane tanks. -2b ‘ Note on plan under septic; the Nitrogen calculation, existing leaching, septic flow in GPD. No floor drains allowed in building-existing or proposed, (it was stated no floor drains now) IS Planning: The applicant has indicated that retail sales would also be accommodated, which is not allowed in the B3 district. Since this is an expansion of use, Zoning Bylaw section 301.2 requires that the site meet current parking requirements or seek relief from the Board of Appeals. Parking spaces nearest to White's Path appear to extend beyond the front of the proposed addition. If this is the case, relief from 301.4.1, paragraph 2 is needed. If Board of Appeals action is required, it is suggested that the Board should note in any written decision that the Zoning Bylaw restricts the use of the site is to wholesale sales only and that retail sales is prohibited. Such a notation might help eliminate future confusion/misunderstanding. a' Water: Service and fire line are not to go under the slab, they need to be relocated and shown to the water dept. on a final plan.
