Subject: Revitalization Overlay Architectural District (R.O.A.D) Application 2022-1
1276 & 1282 Route 28, South Yarmouth MA
For the June 7, 2022 Design Review Committee (DRC) meeting, please find attached ROAD
Application 2022-1 for a proposed development at 1276 & 1282 Route 28 in South Yarmouth
(Assessor Map 60/Parcels 131& 132). The application was submitted to the Planning Board
on May 13, 2022 by Ekaterina & Family LLC and Jay Imad (Jay Mart), and is located in the
B2, HMOD1 and ROAD zoning districts. The Applicant is proposing to demolish all existing
buildings on the two sites and construct a gasoline filling station with five dispensers,
overhead steel canopy, and a 6,560 sf mixed use building. The mixed-use building would
have a convenience store, coffee shop area and drive-thru on the first floor, and four (4)
residential apartments on the second floor. The lots currently contain five cottages, a small
convenience store and two gas pumps with canopy.
The DRC originally reviewed this project on January 18, 2022 in an advisory capacity.
Subsequently, the Applicant is proposing to develop the project using Zoning Bylaw Section
411 – Revitalization Overlay Architectural District (ROAD). For ROAD projects, the Planning
Board serves as the Design Review Authority and will be holding their Public Hearing on
June 15, 2022. The application is also distributed to the Design Review Committee (DRC)
for their input and comments which will be provided to the Planning Board. For ROAD
projects, the Planning Board will need to determine whether the project substantially adheres
to the Yarmouth Architectural and Site Design Standards (“Standards”). Should the Planning
Board make this determination, the Applicant would be able to seek relief from the Zoning
Board of Appeals through a Special Permit rather than requiring any Variances.
The attached application materials include a narrative from the Applicant outlining how they
feel they substantially adhere to the Standards for the Siting Strategies (no narrative was
provided for the Building Strategies). Also included in the application materials are the
1/18/22 Design Review Comment Sheet, the 4/19/22 Site Plan Review Comment Sheet, and
modified project plans.
