Subject to easements, rights, restrictions and covenants of record if they affect the locus and are
in full force and effect, expressly not intending nor meaning to extend the same in the event that
they have expired by operation of law or otherwise.
Also conveying the portion of the ten-foot Bridal Path as shown on said plan which abuts the
above described premises on the west and is a strip of land sixty(60)feet by ten(10)feet.
We, CELESTA P. NICKERSON, as Trustee and individually, and JOSEPH D. NICKERSON,
hereby release our Rights of Homestead with respect to the above-mentioned real estate, if any,
as set forth in M.G.L Chapter 188 and state under the pains and penalties of perjury that there
are no other persons entitled to any homestead rights other than those executing this deed.
For title see deed of Joseph D. Nickerson to Grantor dated September 16, 2004 and recorded
with the Barnstable Registry of Deeds in Book 19253, Page 260.
I, CELESTA P. NICKERSON,Trustee of the BASS RIVER REALTY TRUST,u/d/t dated
September 16,2004 and recorded in the Barnstable County Registry of Deeds in Book 19253,
Page 257, hereby certify as follows:
1. I am the sole trustee of said trust, and I have not resigned, been removed or otherwise
ceased or become unable to act as Trustee or to carry out the duties and functions of
the Trustee under the Declaration of Trust;
2. Pursuant to the provisions of the Trust I am authorized to sell the Trust property. I as
Trustee,have been duly authorized, empowered and directed by all the beneficiaries of
said Trust to sell the real estate located 67 Eldridge Road,S. Yarmouth,MA,to Jay
Porrazzo and Theresa M. Porrazzo in the amount of$275,000.00.
3. The trust is presently in existence and has been in existence continuously since its
inception.
4. There are no unrecorded amendments to the declaration of trust.
5. As of the date hereof, said Trust has not been amended,revoked, or terminated,and is
in full force and effect.

6. There are no facts,which constitute conditions precedent to acts by the Trustee or

7. No Beneficiary is a minor, a corporation selling all or substantially all its
Massachusetts assets, or a personal representative of an estate subject to estate tax
liens, or deceased or incapacitated..
