Request for Review (continued from July 27, 2017:
PETITION #4485: Seaview Motel Condominium Trust, 785 Route 28, South Yarmouth. A
request to be placed on Board's Agenda for required Review as set forth in Decision #4485.
Attorney Anthony Bowers addressed the Board and distributed a letter dated December 14, 2017
(see attached) and marked as Exhibit#1, stating that all Phases I, II, III are completed.
No one was present in the audience.
The Board thanked Attorney Bowers and were all pleased that all the work has been completed.
Dick Martin made a Motion to approve Phase III as completed. Tom Nickinello seconded. Motion
carried unanimously.

Board of Appeals Petition #4485
Dear Ms. Clark,
Please inform the Board that all requirements of Special Permit Petition #4485 are
complete, and:
1. I represent the Seaview Condo Association:
2. The petition initially sought a special permit pursuant to Zoning bylaw s. 104.3.2(4)
and Use s. 202.5(Al2) and or alternative, a Variance from Zoning Bylaw s.
104.3.2(4) and Use s.202.5(Al2)to allow for multi family use of the property.
3. Phase III of a three year review of Petition#4485 has now been complete;
4. The ZBA has previously approved all work for Phases I and II;
5. The Association respectfully requests that all requested Special Permits and
Variances with regard to Petition #4485 be granted allowing for 10 detached, year-
round, residential, condominium units on the property.
Therefore, the Seaview Trustees intend to present these facts to the Board at 6pm on
December 14, 2017 meeting and request final approval of their Petition#4485.

That the public hearing will not be held within 65 days of the filing of this Application, or
That the Board will not take "final action" on the request for a Special Permit within 90
days of the conclusion of the public hearing;
That the decision of the Board on an Appeal or Variance request will not be made within
100 days of the filing of the application.
Further, the petitioner agrees with the Board to extend the time frames within which the
hearing, re-hearing or continuance are to he held and the decision(s) are to be made and filed by
the Yarmouth Board of Appeals, and to waive any rights to the Constructive Grant of this
petition, provided that the Board does act within the time frame of this agreement. It is therefore
agreed that the Hearing shall be held/continued on / /� , and that the
Board's decision shall be made and filed with the Town Clerk within 14 days of the conclusion
