Yarmouth. Map & lot#: 0033.77; Zoning District: B-2. The applicant seeks a Special
Permit from Zoning By-law §104.3.2 (4) and Use §202.5 (Al2) to allow for Multi-Family
Use and in the alternative a Variance from Zoning By-law §104.3.2 (4) and Use §202.5
(Al2)to allow for Multi-Family Use.
MEMORANDUM TO FILE
The hearing was opened and a presentation made by Attorney Paul Tardif on behalf of
the Petitioner. The petition seeks to allow a multi-family use designation for property
located at 785 Route 28, South Yarmouth, MA
This multi-unit facility has essentially existed for over 30 years with neither a motel
license nor relief as a multi-family site. However, it was generally recognized by the
Board that this occurred without any malevolent intent but, rather, by happenstance.
Rather than act on the Petition, the Board felt that the Petitioner should work with the
Town Planner to attempt to address several concerns expressed that could enhance the
site and its utilization in this business zone. The location with the new VCOD District
and the hope that potential upgrades to the site consistent with such distinct architectural
goals could be reasonably considered was also discussed. The Petitioner agreed to
attempt to address the concerns stated, work with the Town Planner and return to the
Board for further consideration.
With an extension agreement being signed, the matter was continued to February 27,
2014 after unanimous vote on Motion made by Mr. Igoe and seconded by Mr. Hart.
