Yarmouth. As shown on Assessor's Map#20 K6. Members of Board of Appeals present: Donald Henderson, David Oman, Les Campbell, Fritz Lindquist, Judith Sullivan. It appearing that notice of said hearing has been given by sending noticethereof to the petitioner and all those owners of property deemed by the Board to be affected thereby and that public notice of such hearing having been given by publication in The Register on 2/28/85 and 3/7/85, the hearing was opened and held on the date first above written. r The following appeared in favor of the petition: Mr. Ojala. The following appeared in opposition: None. REASON FOR DECISION: The proposed project does not produce unsuitable development in marshes, bogs, etc. since the area is already developed with numerous and single family dwellings, exist- ing bulkheads, docks, floats and rip -raps. The project would prevent storm damage to the banks of the river and lagoons. Since the banks support the houses, long term maintenance is important to the stability of the area. The proposed bulkheads will insure that the gradual erosion of the banks will not,reduce the setback distances between existing subsurface sewage disposal systems and the tidal water body thereby facilitating the protection of the water body from pollution. The proposed bulkheading will serve to stabilize the banks and preserve the lagoons and river from gradual degradation and subsidence of the banks into the water with resultant shoaling. Shoaling would destroy their recreational and visual amenity. The placement of.existing floats is to be revised and they will be arranged close to the bulkheading to allow the.maximum space for navigation of boats. Conclusion: The Petitioner is therefore granted the Special Permit described herein, the permit shall be in accordance with the Petitioners Plan. The special permit shall lapse if a good and substantial use thereof or construction has not begun for good cause, within 24 months of approval. All voted unanimously in favor of granting the Petitioner's request. Therefore, the Petitioner's request is granted as above for all of the above stated reasons. No permit issued until 20 days from the date of filing with the Town Clerk Myer R.
